Am I banned to enter in US considering the facts?Please help!!!

I would need you help if possible in a visa related matter if possible.

All your help will be fully appreciated!

Here are the facts:


I came on B1 visa on May 2002;Got 6 months right to stay until Nov 2002; I filed to change to F1 status(student) on Nov 2002,before expiring the visa

After January 2003 my request for changing my status to F1 was denied since I've started attending the school without INS approval.

On December 2003 I've left US.


If I may, my questions are:


1.What is the penalty for starting attending the school without INS approval?

2.For how long I will be banned to go to US since I’ve left US on December 2003?

3.Was I considered to be legal in the US until I’ve got the final answer from INS?

What would be the best approach for this matter?
