Am I a US citizen?

raevsky, I think we are confusing each other more and more. I think for Giovanni the choices are still about the same. Perhaps more inclined to N-400 now, or talk to a good lawyer. Anyway, I think this is one other reason I didn't wait any time to apply for a certificate of citizenship for my child (who derived citizenship through the child citizenship act of 2000) after we (the parents) naturalized. Laws change over time, people forget how the old law was applied, everything gets murkier. If someone reads this and has a child in this situation it might make sense to save the child some problems and get passports as soon as possible and consider obtaining a certificate of citizenship sooner rather than later. Not because it is better than a passport, just that documenting the case and getting an IO that understands the issue might be more difficult if a certificate needs to be obtained two decades down the road.
 
Citizenship issues are pretty much important, and that is why well known by government officials. However, all you say still makes sense.

You guys are confusing each other and pointing Giovanni in the wrong direction.

Giovanni is, as LolaLi and some others, correctly explained before, allready US citizen and should use N-600 to apply for a Certificate of Citizenship.
 
Applying for certificate of citizenship will provide another official proof of him not being a US citizen. Much longer one than applying for a US passport.

Look for Chart C that discusses derivative citizenship. They mention stepchild, but my understanding of that is not legally adopted stepchildren. In that narrow interpretation a stepchild doesn't derive citizenship. To be honest for me the whole issue is not as crystal clear as you see it. If I have a doubt is because I haven't seen the exact case of naturalized mother, natural father not naturalized and adoptive father being a US citizen, I presume by birth. Anyway, I think I am going to drop out of this thread. I think I have provided as much information as I have been able to find and I am not the right person to tell someone if he is or not a citizen. I hope Giovanni takes all this information from you, others and I, and the books and chooses one course of action that fits his needs.

Thank you one and all. I'm so grateful for all the great information! Total strangers assisting me in such a way is quite touching . Who wouldn't want to be a citizen of such a country.

I intend to proceed as follows. I will file form N-600 and cross my fingers. I will not apply for a passport because I believe it would be rejected out of hand. If get official word I'll post that. For now, I'm out. Cheers.
 
If you qualify either passport or n-600 would work. just have to have the proof as USCIS says you can go for both but passport first would be a lot faster than the cert. itself
