Aliens getting married in the US

Hi,

I am on a H1 visa in the US. Me & my girlfriend, who is in the US visiting her relatives on a visitors visa, plan to get married. We will not be able to get married in my home country due to religious reasons. ( We would probably get killed). Therefore, we have no choice but to elope.

I desperately need to know if (a) we can get married in the US and (b) will there be complications in the H4 - does she have to go back to our home country ? Will she have to change her name on the passport ? Is there any chance of asylum, in this case ?

Could someone please let me know.

No complications. Visit your local city hall and find out about conducting a civil ceremony. Most probably you will have to pay a small fee, take some classes and then appear before a judge.
A local church can also do this for you.

Get the marriage certificate and file I539 (with letter from employer, your h1 copy, passport copy, her passport copy, recent paystubs etc.) to INS. See INS website, forms link for details.

No issues..

Hi - I was in the exact same situation (but she was in H1), we got married here, converted to H4, no issues. If she needs to get H4 stamping on the passport, she has to travel to home country otherwise no problems.
