after NOID response, both me and my wife got FP notice on same date, is it GOOD NEWS?

Please check this thread http://www.ImmigrationPortal.com/showthread.php?t=141272&referrerid=31893 to see the history, today I found in my mailbox my finger print notice (for FBI) for SEPTEMBER 2nd ( the date my wife has got) I changed my attorney perhaps my old attorney got it and he neglected it !!! thank god atleast I got by week delay, I am going tomorrow to get it.

Now, Is that means my repsonse to NOID is accepted and thereby they have approved my case and this is just a formality before I get the confirmed approval notice?

Guys!!! please share your experience, I can't wait... as you know (see my threads...) I need to join this FULL TIME GOVT job by October 5th.

If they were going to deny your case, they wouldn't waste time and money fingerprinting you.

It could be a good news probably. They cannot deny your applications until they adjucate your case as they continue processing your case since you received your fingerprint notices.

Is your govt employer your sponsoring employer? If not, you can join your govt employer by using your EAD before your 485 is approved. But if your 485 is approved and you are still at your sponsoring employer, you cannot join your govt employer until 6 months or 1 years is completed. Do you know risks that the immigration can revoke your gc or pose problems at the time of applying for US citizenship if you leave your sponsoring employer early or right away after your I-485 is approved? It is your decision.

By the way, the full time govt job requires US citizenship by the law under Bush Adminstration? Are you sure they allow you to join the full time govt job even though you are not a US citizen or US Permanent Resident? Just be careful.

CITIZENSHIP is not much of interested to me since I wanna return to india after a decade or so.. I might just keep renewing GC every decade or so...

Yes, I can and love to join the govt but my job title is different and my pay is little low (by 20 percent than my approved labor rate) therefore my lawyer is against it. Now, the govt offer I have on table (completed interview and join date on october) might require atleast a permanent resident !!! however, the job application had under requirement column something like this "should be US Citizen OR authorized to work in US"

So what would you do, if you were me?

well, are you sure that job description (not job application form) asked you if you are authorized to work in USA? Did you ask your govt employer about requirement? Be careful. You can accept a job offer if you are sure about requirement.

Ask anyone in this forum or your lawyer. Just make sure. Good luck on your new job.

I asked someone with HR NOT the exact person who I have been in contact with, the reason is I don't want them to decline the offer until atleast Oct 5th (deadline to start the job) perhaps I might get GC approval by then.

Anyway the HR person said as long as SS card says can work with work authorization then I should be fine, fingers crossed.... by the way I had LUD on my case and done FP2 last week...

By the way, SS card is not an immigration property.

Do you have the form like this: http://media.newjobs.com/opm/www/usajobs/pdf/ei-25612.pdf ? I checked with my friends who are federal employees and they said most federal jobs require US citizeship. If you are working on non-defense jobs or non-intelligence jobs, it may be okay, but I don't know.

Make sure to ask your lawyer if you have a lawyer about federal jobs requirement.

Mine is not FEDERAL JOB rather a COUNTY job i.e. like state govt you can say. I can think I can tackle that easily by simply taking vacation on my current consulting job and work there couple of weeks and you would obviously come to know that.

Big deal is, how much of big concern is getting paid lower than my labor rate approval? that is where the BIG STICK is from my lawyers perspective...

two more weeks to go.... pressure is building....
