Hello i m from India and me nd my husband are planning to file for asylum..But i heard dat after getting citizenship indian govt is not giving visas and we cannot go to India...Is it true or is there any way around bcoz my parents nd in laws are very old and they will need us at some point of the time.

Any suggestions whether we shud apply for asylum or not.bcoz my husband is very fed up after spending 15 years in USA legally with al the taxes paid and stil not geting GC(bcoz of EB3 category moving slowly)..

If v get GC nd citizenship at the cost of not ever going to visit India for our whole life then it's not worth i think.PLz comment any suggestions plzzz hurry

Applying for asylum is not like applying for a visa. It's not one of your options because you're tired of waiting for your Green Card to be processed. And a fake asylum application IS ILLEGAL!

Are you crazy?? You want to apply for asylum because EB3 category for India is backlogged? On what basis do you intend to seek asylum?

1.) You have not stated any legal basis to even seek asylum. [You give the impression that you don't know what it means.]

2.) There is a one year deadline to apply for asylum after entering the U.S. [You give the impression that you have been here longer.]

3.) In order to apply for relief after one year has passed, you may baser the application on a "change in country conditions" OR apply for withholding of removal (WOR) which sucks and NEVER leads to a greencard OR apply for CAT relief. BOTH of the later two have a higher standard and burden of proof to show that your removal would "more likely than not" result in persecution, torture or certain death at the hands of the government or with the government being unwilling or unable to stop a private party from doing that to you.

4.) India does give people a hard time when those people have claimed asylum against the either evil or inept Indian government which is how you have to portray the government in order to get asylum.

5.) Anyone with a legitimate path to legal immigrant status who makes a false and/or "frivolous" asylum claim will be banned from that other path forever when the asylum gets denied.

6.) Never even think of applying for asylum unless you have been persecuted or have a true reasonable fear of future persecution.
