Thank God my forms confirmed received by KCC.
Please when will the forms that require the Affidavit of support be received?
I have filled in that my wife and daughter will accompany me. Does this mean we all have to go at once or I can go and return for my family within the first 6 months in which visa is granted?

what?

the winner can enter first, and the family can enter either at the same time, or later (within the 6 month expiration).

Talk about Affidavit of Support so much and important. This form (AOS) when and where will it be made available, and at what point will it be required and how to get it?

you need to get a co-sponsor with sufficient income. It needs to be a US citizen or a permanent resident. He/she doesn't have to be your relative.

yes, that's a good number. You don't need to have an account. REad the forum. Catseyes wrote a lot about it.

Please don't refer to the affidavit as AOS. AOS stands for Adjustment of status.

If you have a relative or a friend who is a US citizen or a permanent resident, who has enough income to sign the affidavit for you, then you ask them to fill it out (form I-134 on www.uscis.gov). All the required documents are listed in the instructions to the affidavit. Your friend will fill it out, sign it, notarize it and attach all the documents to it. Then he/she will mail it to you. Then you'll bring the affidavit to the interview.

Hi Lucy,

I have 2 questions...

1. I got one I-134 for myself and my husband and daughter are listed on the same I-134 on item 3. Is this ok OR we need separate I-134's ?

2. My relative is self-employed hence his income is not on W-2. He has to declare his income and total income for last year is only 37806. Also - he has other deposits etc listed on I-134. So is the poverty guideline checked as per income on W-2 or 1040 or the I-134?

Thanks
Abdul

I think it's not nessesary to be a US citizen or permanent resident to give an affidavit of support. It can be any person with sufficient income, even in the native country. that's what I did when I got my student visa and my friend did when she won DV lottery, she got the affidavit of support from her relatives in the native country.

if the affidavit is from a person in a different country, how do you think the US government is going to enforce it? By signing the affidavit you promise to support a person at or above the poverty level. If you don't live in the States, the US govt can't enforce it - therefore, it's useless as a proof that you will not become a public charge.

one per family is sufficient

He will use his income on [1040 + deposits + property + other income sources] to determine whether he has income that exceeds 100% of poverty level for his family and your family combined.

in my case it worked and my friends case too. so if anyone won a green card and they dont have anyone in the US then they wont be able to prove they can support themselves? i don't know where you get that information but I know for sure people from different country can give an affidavit of support.thats my own example.

well, my parents weren't asked for one, but that doesn't mean that the person next in line wasn't asked for one.

An affidavit signed by a foreigner is unenforceable, and therefore, is pretty useless.

so if anyone won a green card and they dont have anyone in the US then they wont be able to prove they can support themselves?
sometimes they can, sometimes they can't - and in that case a consul didn't grant visas. It has happened before.

well like i said, at least 5 people i know, and myself got affidavit from parents in the home countries, so it means its not useless :). when i was getting my student visa , i was told by lawyer that its better to get affidavit from my parents then from a non-relative in US (i had that option too).

well consul rejects visas in many cases , but affidavit of support can be given from US resident or foreign national, and in both cases visa can be granted or not granted.
