Advice with AC21 portablity

Recently, USCIS issued an RFE asking for employment letter. My present company replied for it by sending an employment letter. Online status got updated on 09/24 that USCIS received my RFE evidence.
Right now, I got an offer from another company. New company is willing to support me with documentation required for using AC21 portabilty.

is is advisable to send USCIS supporting AC21 documents or wait till they ask for those documents?

---- if you want to join new company then send new company letter to use AC21

----- if you want to change inform USCIS becase they got RFE responce and why they will send RFE again?? they may approve the case with out ant more RFE

Is there any form to fill to use AC21 portablity? or just the letter from new employer is good enough.

-- no form to fill, just search this thread it has sample AC21 lettes
or just the letter from new employer is good enough.
you need to send:
copy of your I-485 filing reciept + your Intent change letter to use AC21+ new employer's future permanent job offer letter ( better also attach 2-3 recent pay stubs from new employer if you dont have at this time no problem)

By any chance do You have a sample Format letter reporting to INS that I am representing my case myself hereafter and don't send any letter of my case to my previous employer's lawyer(s).

Should I fill in the G-28 form ( not sure whether that is the correct form)?

Also , please confirm , whether the above mentioned documents you mentioned are sufficient while sending this AC -21 letter to INS ( or do we have to attach Copy of Labor Approval Cert., , Copy of I-140 and EAD Copies).

I have got a letter from my Current Employer , in the same format You provided in one of your threads.

Please Advise.
 
beluri01, i recommend you NOT to send AC21 at this point. just wait out until you either get I140 approval or second RFE. It's still a gray area if you can use AC21 before I140 approval. At this stage, your I140 is still consider pending. Are are almost there, so wait and do not send AC21 to complicate things.
 
My I 140 is already approved. I do not plan to send AC21 documents. I would only send if there is a second RFE.

---I dont have Sample letter, you can write directly

-----no need of LC copy or I-140 copy they have LC and I-140 records, they can know anything pending or approved for you by penching your A# in CLAIMS

Hi, Ginu,
I thought previous posts said copy of LC (A and B) are needed. Has this requirement changed? I am planning to let the current company know today that I am leaving. Any document should I ask for?

--- LC copy is not needed for AC21 but if you have or can get FORM ETA750A then on that LC form in item 13 are your skills/job duties it helps your new employer to write the same job duties on future job offer letter

----- ask the approved LC COPY it will have form ETA 750A and ETA750B
ask the copy of I-140 approval or I-140 filing reciept and copy of I-485 filing for you and your dependents, if the employer does not have ask the company lawyer, company lawyer may not give you LC copy and I-140 approval without permission of employer.
