Advice needed - Oath Ceremony and temporary move to Canada

I have a situation that I need guidence on. My oath ceremony has been scheduled but my company wants to relocate me to Canada for 2 years, with a move date prior to my oath ceremony. Will this create an issue at the oath ceremony itself? The move is temporary, I still own a home and investments in the US etc etc. I filed based on the 3 years rule having married a US citizen since 2002. I have resided continuously in the US since February 2005.

Many thanks

Jim

If at all possible don't move before the oath. If this is absolutely not possible, go there and come back to the oath and list that trip in the oath letter. Go to the closest passport office with your ticket to Canada and apply for a same or next day passport. Perhaps it would be best if you buy a round-trip ticket from here to Canada. Anyway, it is all a gray area of which I don't have a very good idea, as you have already had your interview. Theoretically I think it might make a difference if you go to work for a U.S. company or a foreign company. Anyway, my guess is that we're talking here about a few weeks, aren't we? I don't see much issue on scheduling a round trip ticket to Canada, live in a hotel for those weeks, and come back to your ceremony.

Thanks for this. The work permit itself is a separate piece of paper, as opposed to a stamp in the passport. Do they check your passport at the oath ceremony? At this stage I will be in Canada for a total of 14 days prior to my oath ceremony.

No, they don't check your passport. I think you should be fine, just mention your trip to Canada in the oath letter. I don't think a 14 day trip to Canada is going to raise anybody's eyebrows. For your future protection I think it would be better if the trip has as much as possible the looks of a temporary trip, that's why I suggested to go out of the U.S. with a round trip ticket and live in a hotel during those 14 days. That way I think you might argue that you went there for 14 days to see if you would actually relocate for good to work for your company or not. Anyway, one way or another I don't think you're going to have any issue with this (in practice, theoretically it might be different).

Good luck.

Thank you. I will be staying in temporary accommodations and will have a return ticket, so I agree that there should not be any problems.

It is fine, just make sure you come back for the oath and list the days (from/to) being out of US between interview and Oath. But do remeber, those extra days DID not break your continues residency requirement.

Just don't tell the IO that you are planning to relocate to Canada for a while - it will unnecessarily complicate your life. You took a 14 day business trip, and that was it....

If possible, try to convince your company to delay your relocation date by the 14 days, so you wouldn't have to leave the US at all before the oath.

You should be fine, but if at all possible, ask them to delay the re-location by a fortnight.
