Advice/help?? sponsoring Mom, with dependent step brother?

I am a US citizen and I am applying to bring my Mother to the U.S. from Dominican Republic, I also have a step brother who is 12 yrs old living with her.

I spoke to an attorney and she mentioned that I will not be able to bring my step brother along with my mother on the same application, even if she is his dependent.:confused: Another attorney said I could bring him.

Is this true? I spoke to other people and they have said that he can also come on the same application?

Will my mother be able to bring him to the USA when I apply for her is the main question, he is only 12 yrs old?

Anyone with similar experience please give me some answers thanks.
 
The first attorney is correct. Your brother can only be petitioned by you as a sibling (about 12 years of waiting), and not as your mom's derivative.

Your mother can petition for him as well when she becomes a resident. The wait is about 5-6 years for minor children of LPRs.
 
Immediate Relatives of US Citizens (such as your mom) can not have dependent immigrants (such as your brother) come with them on an I-130 petition. Period.
