Advance parol Supplement for part 7, please check

the only reason me and my spouse are applying for AP is because we want to use EAD and we dont want to go to visa stamping....(our H1 is valid for another 8 months).......please see if the below is enough???

My I-140 application “SRC********“ has been approved and I am filing my I-485 application for adjustment of status(with this packet) with USCIS. I wish to use Employment Authorization Document to legally work from "Dec 01, 2006" onwards. Based on the above facts, I believe I qualify for Advance Parole.

I am planning to travel for a month to India to visit my elderly parents and attend marriage of my sister during Dec 2006 and again later in April 2007. Please approve my application for Advance Parole for multiple trips.

If you have any questions or need additional information concerning the above, please do not hesitate to contact me. Thank you for your kind attention and cooperation in this matter.

you better need to attach cover letter with your I-485 packed and list what is attached with I-485, like form I-131 for AP and form I-765 for EAD

then for I-131 and explain item 7:I am planning to travel to India to visit my elderly parents . attach the Explanation of particular item, fee check Top of I-131 form

I-765
Employment Authorization Document , just attach the copy of I-94(front and back) 2 photographs(with name written on back with pencil) Copy of DL, Copy of passport pages. Fee check top of I-765
** photographs with I-485 form, Photographs with I-131 form, with form I-765 better in transparent envelopes.
 
thanks ginnu.......i was thinking as though they need some special reason to issue Advance parol...

and if one uses EAD then you cannot use your H1 visa for travel...

but i think you make more sense......i will follow your advice... thanks...

--------------------they dont care for reson and for the date you write you want to travel

------------ If H4 uses the EAD then H4 STATUS is not valid but one CAN enter again with H4 visa stamp and can be on H4 status (if Primary is on H1 status). If the Primary uses the EAD then H1 is invalid but if you have valid H1 visa stamp you CAN enter on H1 status again. You are filing your I-485 and spouse I-485 with out lawyer and may commit mistake better you remain on H1 status so that if anything goes wrong with your I-485 you can be on H1 status. I-485 filing is your last step of GC and you don’t seem to be expert in filing and that is not saving, you should have taken the services of a lawyer so that paper work is filed correctly and no mistakes.

But since you've already started preparing your I-485 package without a lawyer, I'd say - go on, you can do it. All the advice that ginnu alone has given you already is tremendous help. But I second ginnu in encouraging you to maintain your H1 status during the whole AOS process, just to fall back on in case something should go wrong with your I-485.
 
primary H1 is non-quota in Education institute type........very easy to get a new one......so primary will use EAD......if anything goes wrong with 485 get a new H1 in 30 days time with premium processing....

spouse is now a different story.....H1 in a quota category(IT worker).....but EAD will offer a ton of freedom to work.....hence the reason to switch.......but spouse will be in a mess to get a new H1 if anything goes wrong...

will have to ponder a bit..
 
ginnu and civ2ru.....why do you guys think that if a candidate qualifies but he may make minor mistakes in filling the form or sending documents.....uscis will deny his case??

sorry i beg to differ on this......my case may get delayed thanks to uscis for not publishing any instruction about each field on their forms.......and not asking specifically for every document they want to consider.....but they will not deny it unless i do not qualify....

I do not beleive in hiring a attorney just to file some applications........unless of course uscis will make things more obscure so that people hire attorneys...

You came to this forum asking for people's experiences and opinions, and "it's preferable to maintain one's non-immigrant status during AOS process" happens to be my opinion. Especially if you're taking the "no lawyer" route (which I did, as well). But you do what you want to do.
