Advance Parol question

Hi there

Can someone tell not granted asylee and his or her case is panding at the immigration Court untill next hearing is allowed to apply to ADvance Parol.

What he or she suppose to do to go broad and meet his or her family in third safe caountry?

How long is he or she allowed to go thired country?

If someone experienced with it or knows about it, plz give me a brief explaination.

The simple answer is NO. If you leave the US while your case is pending, you will not be able to enter back in to the country; USCIS will consider that you have abandoned your application for asylum.

I dont think you qualify for any travel document or advance parolee... but if CIS grants you the advance parolee the chances in not letting you enter the US are very high.

In my opinion, wait till you have your asylum granted.

My next hearing takes place in one and half years, it is so long. I am OK with it, however my family is getting trouble in my homecountry. I am worrying about my family. It is Ok for me even my next hearing is in two or three years but I have to resque my family some, you know I mean

So, I am planing to go third country and meet with them in there and apply UN for refugee satatus and also find them safe place in there and come back to US. in this way he don't have to worry about so much.

I read I-131 form for advance parol, it says I can apply and go to broad. But you are telling there is no guarantee to reenter US right?

HAve you heard this or experienced with it?

I completely understand you; however, you have to understand that as an asylum applicant (with no asylum grant) there is no guarantee they will let you in... they may or may not...

If you have a good reason, in which you have, they may let you in with no problems... but like I say I never heard of a similar case that they let the applicant in...

This is what CIS says about it:
"Asylum Applicants: An asylum applicant who leaves the United States without first obtaining advance parole shall be presumed to have abandoned his or her asylum application. Advance parole (see: USCIS Form I-131) allows certain aliens to return to the United States without a visa after traveling abroad. Asylum applicants must receive advance parole before leaving the United States. Advance parole does not guarantee that the alien will be paroled into the United States. Rather, the asylum applicant must still undergo inspection by an immigration inspector from United States Customs and Border Protection (CBP)." quoted from USCIS website

You have 50/50 chances... make an infopass appointment and ask those questions and hear what they say about it...

As far as the UN refugee status... I am not sure how easy or how fast that is... but I heard that its very complicated and takes a long time.. anyhow...safety of family is always worth it...

If I would be you, and the situation with my family is really really bad, I will try to get an advance parolee -if they approve it-, then, go to the third country, save my family, do the UN refugee status for them, and come back to the US...if at the end they dont let you in into the country... you can go back to the third country that you were and try to get the UN refugee status for yourself too... it may not be the same as having an asylum grant in the US, but at least you have your family safe.... that's just my opinion...

But definately make that infopass appointment....

You can apply for advance parole. The problem is that they have not been too keen to approve advance parole for asylum applicants.

If they do grant the request I do not think you need to worry too much about not being permitted to come back.
 
Diego,

I would recommend you to sleep on this matter so that you won't put your case in jeopardy... If you think that the one and a half year you have to wait for your next hearing is a looong time, just keep in mind that some of the people in this forum have not gone out of the country in many years... That's a price we have to pay... Is it worth it ?? I leave it up to you...
