Has there been any cases that had success of AOS for a TN visa? We got selected for the 2024 DV Lottery. Submitted DB260 mid May but hubby got a TN Visa so we entered the US on the TN on 1 June.

AF65000 which is quite high.

So do we do AOS or wait for an LN CP from the DV lottery?

Any advice or suggestions?

1. Yes.
2. It’s your call on whether to go with AOS or CP. You’ll have to decide as to which option works best for you guys.

I recommend you go through the first post on DV2024 AOS thread. Following which you should click on the link for the AOS process spreadsheet and spend some quality time going through the spreadsheet to enhance your knowledge of what the DV based AOS process entails. You’ll also see a tab on that spreadsheet which has the pros and cons of both CP and AOS process. That should hopefully help you make the right decision.

If you guys want to stay in US and want to continue working on TN, AOS is the preferred choice. CP will require you to leave US get other documentation (e.g. police clearance from all the countries you have resided etc..) that CP filling requires etc.. Not sure if you want to risk re-entering in US on TN while you are processing greencard application
 
My worry is our high case number of AF65800 and the amount of time between us getting current and the cut off date of 30 Sept. If we can only file in July/Aug there will not be enough time to be adjudicated in time?

I recommend you take a look at some of the past Timeline spreadsheets to get an idea of how long on average it took some of the previous selectees who processed their selection via AOS. You will some cases of folks who filed for AOS in July/Aug who successfully completed completed the process on or before Sept 30th. You’ll also see cases filed in January/February who had to wait until August before they got scheduled for their interview or got approved. So basically the time you get to file is not the only determinant of how soon you may be able to complete the process. While when you become eligible to file plays a major role, other things such as your applicable FO, and your background check clearance also factors into how long (or short) each applicant’s processing time may be.
