Additional evidence after BIO Code3?

My case has not been updated even after I took Code 3 in Dec until today I received the following message through email.

"On March 15, 2006, we mailed a notice requesting additional evidence or information in this case. The notice explains in detail what additional material is needed. If you have questions about the notice, what is required, or if 14 days have passed..."

So what could be the "additional evidence or information" they request? Anybody has same experience? Thanks, my friends.

Thats a good sign... it means that after they receive the RFE they will approve your case...

The RFE could be many things... Your national passport, pictures, old RTD... marriage evidence... it depende in you case....

As soon as you receive the RFE mail it back right away... hopefully by next month you will have your GC!

I have similar story. Waiting for RFE...

I just received the letter of requesting additional evidence today. The USCIS request 3 things for me to do.

1) Submit an affidavit for failure of completion of a section in I-485
application.

2) Submit a new photo.

3) Submit copies of passport, travel document and I-94 if I traveled outside
the U.S. since grant of asylum.

I don't know how to prepare the affidavit, any friends have a sample? It will be highly appreciated if some friends send me a private message or post here.

Hi Colomb,
Are they requesting you to properly complete part 3 section C of I-485? If it is, you got it! I got same RFE. All I did is just sending back that part with "none."

They didn't request me to submit copies of passport or photos though.
Actually I have a RTD, but I never used it after I applied. Wasted! :o :mad:

Thank you for your info. I got exact the same request with yours, but they need an affidavit, so I'm going to send an affidavit. My case is handled in NSC as well.

are RFEs always requested?

Hello everyone,

Will every applicant be asked to submit RFEs? I mean if everything that was required with the initial application was submitted properly, do they still need aditional evidence from every applicant or is it case by case? As far as I know my application is completed fully, and I have submitted my medical and Biographic info, will they still need something else? This might be a stupid question, but I was wondering if everybody who has been approved already has been asked to submit RFEs or if there are people who have been approved without a request for RFEs.

I did not get RFE. Some people get, some do not get RFE. I have seen in this forum that the most common type of RFE are:

1. Copies of passport, RTD, I-94. I think if you have not travel after you submit your I-485 they will not ask you for this.
2. A photo. If you did BioCode3 some time ago (more than 2-3 months), they may ask you for a new pic.
3. Affidavits of several things as illegal entrance to USA.

Which format do you use for that affidavit?

Fair enough. Mine's maybe alittle unprofessional. What I did is cutoff that section and put my answer "None." to that field, and then put my name, A#, and Receipt# there. Don't know if it works. So far no updates on that. Good luck to all of us!
 
I just got everything done and mailed the reponse to NSC by certified mail. The envelope NSC provided is just a normal one and it's so difficult to put all stuff in. Let's wait to see what's going on next.

Colomb, I also mailed by Express mail. I wonder if that won't create any problems. I sent overnight.

Yours will arrive earlier than mine. Anyhow it doesn't make sence by choosing what kind of mails, the key point is that they CAN get it!

Can you please paste here the sample of the affidavit letter that you mailed to USCIS. Did you have it notarized?
