I applied in EB-1 OR category few months back. Recently i got couple of publications and citations. I'm wondering if i could provide this additional information to USCIS? If yes, pls let me know how? My petition was through my University lawyer but i doubt if she would take extra pains for my petition.
Thanks

when you get RFE you can provide these things.
some people say it will help. some people says it may not.
USCIS look the eligibility as on the day when u submitted your application and not any time later.
you can not submit any additional documents.

why do you want to send it now and make things complicated?!! if you get an rfe, you can use it then.

btw, where and when did you file? also please post your credentials.

I think you guys are right. I should wait till the time decision is taken on my petition.

Also please let me know about my priority date. Will that be 10/13 or 11/07/07.
Thanks

Hi eb2007,
plz post ur credentials I think u and me are almost in same boat. U will hear goodnews soon I guess. In this forum one october 2007 case was approved.

Hi Tony456
How is that possible that a case from Oct 2007 got approval? This is because USCIS is still processing cases filed around Feb 2007.
Others pls correct me if I'm wrong...

when to pick up your file

Hi Tony456

I got confused too. But to my understanding, the USCIS people pick up files just by the lottery numbers. If you are lucky, yours may be picked even though the processing time is not up to your case yet. They put the processing time on the website so that the people (like you) who are still within the time cannot complain (even they see other people got approved).

How is this possible?? How can they randomly pick applications based on lottery when they process the petitions on the basis of order they receive.
Did it happen with anyone before??

They most definitively do NOT process in the same order they receive applications. For a while I thought its in some other meaningful order (i.e. order in which applications were received, but skipping applications for people who can't complete I-485 stage due to unavailability of visa numbers), but they clearly don't do that either. Its just pretty much random. They pick up a few files here and there and work on them. The rest runs into the processing time and the applicants start complaining at which point they try to dig them out from under whatever pile they lost them under and process them (if you are lucky).

I agree with all of the above.
It depends on where is your file in the pile in front of the officer...top or bottom.
I submitted my NIW application with a RD of Dec 10th 2007 and got approval notice on Feb 15th 2008. MY case was well prepared too and it was all done by the guidance of experienced forum members. no lawyer!
Thanks to all and good luck to the rest. Remember, there is a set time for everthing that happens to us.

That is really amazing randomness!!!! Anyways let's hope that we become the beneficiary of this approach. But it looks like you can expect surprise at TSC but not at NSC......
Other members......did any one else get out of turn application processed..

hnks - congratulations! on your NIW approval.. that was fast! by the way which country are you from - ROW/India/China

i wonder what happened to helpinghand - did he file his NIW in NSC or TSC?

Hi shankyy
I can see LUD in your I140 case on 01/02/08. This is kind of surprising as I filed well before you at NSC (EB-1 OR, concurrent, RD 10/13/07, India) but there is no LUD so far??
Do you see any specific reason for that? What does LUD in I140 really means? Is that your application now under adjudication process?? Others also pls guide..
