Hi Gurus,

Do we need Advance parole document while leaving the country or while re-entering the country?
I was wondering that we apply for advance parole and go to India. When it gets aprroved, my friend can post it to me in India and I can use it to come back. Can I do this? suggestions???

You need AP only if you don\'t have a valid H1B visa

If you don\'t have a valid visa then you have to apply for AP and
you can\'t travel till your AP gets approved.....Travelling like the one you asked will jeopardize your 485 case....
 
what happens if you have valid H1/H4 Visa

when you travel outside country but while you are in India.
can we use AP only to comeback if you lost the status of H1/H4 as you are approved for GC here meanwhile.

in a simple sense can we use AP to reenter when we left the country with another valid VISA but that VISA is not valid anymore by the time return.

What INS says ...

This is from a recent murthy bullettin (search the archives in murthy.com). "The applicant should have a AP even before leaving US. " But there was a wishy-washy statement at the end which was vague about using AP that was approved when the candidate was abroad. It was very difficult to intrepret whether it is allowed or not.
However (Not to scare you), let us take this step further.
When you come back the POE officer might notice that the exit date is earlier than the AP approval date. Do you want to take the risk ?

Even if the officer at POE misses it, what if it is caught at the time of stamping (when INS is supposed to do one last minute check of continous status maintenance )?
 
So basically it amounts to a judgement call based on vague information. I would suggest to consult your attorney who is the only person who will come to your aid at the time of crisis and act accordingly.
