Active Immigration Petiton - Lied at the time of B1/B2 visa application

Hi Everyone,

My mother has filled a petition on my behalf, which i am hoping to be get through early next year. I have a concern that I have B1/B2 visa valid for 10 year, which i got in 2008 and at that time in the visa application form I mentioned that nobody has filled immigration petition for me and none of my relative lives in USA.
Will this be big issue or will make any difference in issuing of immigrant visa? please share your experience, will be really greatfull.

Yes. Hiding a material fact is very serious. If your mother filed her I-130 before you submitted your DS-156 in 2008 and you hid that fact, you committed perjury. You are looking at a possible life ban as a worst case scenario.

What if I go on visitor visa i have and then apply for adjustment of status while staying with US. I am only child of my parents outside US and I dont want to spend rest of my life without my parents.

If you enter with a B1/B2 and apply for AOS, USCIS will almost surely contact the consulate that issued your visa and will very likely catch the lie. And if they don't discover the lie during the AOS process, but find out after GC approval, that makes it easy for them to revoke your GC because your GC was based on AOS which was based on a fraudulently obtained B1/B2 visa.

Then they may have to move back to or visit you in your home country. Lying to US immigration authorities has serious consequences. Your dishonesty may change your future forever.

You will get no sympathy from the many users of this forum who play by the sometimes seemingly arbitrary rules.

I was going through some of the forums and have seen lawyers talking about Fraud Waivers when someone has committed fraud or who misrepresents a material fact when procuring a visa. Is this thing true? has anyone experienced this before? Please share

You committed a serious crime, you told them you didn't have any relatives in the US, even though your parents lived here? Am I nuts or you just disowned your parents to procure a visa? You lied which is a big NO...NO...NO...NO....!!! Unfortunately, if USCIS does a thorough evaluation of your case, then you should be caught and your azz handed to you in a gucci bag. You will likely face a life ban in the US. If you had not disowned Christ before the rooster crowed three times, then your case would have been easy to complete... Lies have serious consequences and being the only child, didn't your parents raise you to be honest and upright citizen? Guess who is "smillin" now....USCIS.....

I am not aware of any waivers which is issued to people who flat out lie about their relatives, let alone their parents to procure a visa. If such a waiver existed, guess how many people who will lining up at the US Embassy to lie their way into a visa issuance, arrive in the US and apply for a waiver...."Oh...I intended to remain forever in the US, but I lied about it to get a visa, can you wipe my slate clean so I can get a greencard?" Unfortunately, you might have to carry a dead hog to immigration..
 
The law provides a limited opportunity for the alien to waive his or her ineligibility but
the waiver applies only if (1) the alien “is the spouse, son, or daughter of a United States
citizen or of an alien lawfully admitted for permanent residence” and (2) if it is
established that refusal of the admission would result in extreme hardship
to the alien’s
citizen or permanent residence spouse or parent


What hardship will your parents incur? They survived without you for a significant period of time.
They may be glad that their liar child is not nearby.

In any event you need a lawyer - a very good, extremely expensive one.
 
Be a man and be prepared for the consequences of the actions you took. As you can see already, other forum members are sending you the same message. Most of the time, we reap what we sow.
With regards to living without your parents, they can always move to whatever non-US country you call home.
