AC21 with Salary Increase

Hi,

Have applied 485 last year (May '03) and have EAD & AP. Would like to change job in the similar field with 24 % hike in the salary. Does this cause a problem?

I would appreciate your opinions/suggestions with procedure details for AC21.

Yes, my I-140 was approved long back. One more question - Is it mandatory to send the AC21 letter to INS? If so, who should send the letter to INS - myself or the new employer?

It is up to you

It is up to you if you want to send AC21 letter to INS. I-485 filed in Jan 2003. I changed my job in Oct 2003. I sent the change of letter last week to USCIS. I dont know if USCIS will send an RFE for me when they process my case.

------ it is better to inform USCIS becase they will know that you have changed intent and joined new employer and are using AC21

--- you have to send your intent change letter that you want to use AC21 and would like to work with new employer XYX after I-485 approval on permanent basis + new employer letter for future perment job offer ( skills should be same as on approved LC) + copy of your I-485 filing reciept
