AC21 rule?

Hai..

I filed I140 in Aug'02 and got approval in Jul'03.
Filed I485(concurrently) in Jan'03(RD) and Apr'03(ND)


Questions:

1. Can I use AC21 now?

2. Do I need to get any documents from current employer before applying AC21?( I have I140 approval notice copy, no LC approval copy)?

3. 180days is from Receipt date or notice Date of I485?

4. Do I need to wait for 180days from date of approval of I140 for AC21?

--- if you filed I-485 based on approved I-140 then it is not concurrent filing

---if you hit 180 days after filing i-485 from jan 03 and your employer does not revoke approved I-140 for 180 days after your I-485 RD then you may be able to use AC21 if you satisfy all the other requirements of AC21

Is there any way I can get the LC Copy? from INS or Labour Dept?
 
It is better to have LC copy so that you can submit new job letter for AC21, if one knows the job title or skill set written on approved LC it makes lot easier to draft the new letter of similar/same job, approved LC has also Occ Code on it.
You cannot get LC copy from DOL or BCIS, try to find copy from the lawyer who filed LC or I-140 he has the copy and your employer may be having the copy of LC
If you cant get the approved copy ask for the copy of the papers that were filed for LC the ETA750A has your skills on it
