AC21 pay question

Question with regards to AC21 portability:

AC21 requires that you have the same job profile and same job pay. What if you moving from a low cost of living city to higher cost of living city? - In this case, how do we determine the salary requirement?

Please shed some knowledge on this issue.

I have a question. In my new position my duties will be the same as in the previous one however the amount of time I work is more, because this company has more clients. So they pay me salary but I work circa 52 hours a week. So they give me a 'package' which includes overtime (which is not shown on my paycheck as I am a salary employee).
So how do I calculate my hourly rate (because LC lists Hourly rate not salary?)

Just because the LC lists an hourly rate doesn't mean you need to convert your current pay to hourly. Just give them the salary. My LC listed a salary, and I referenced an hourly rate in my 2nd AC21 letter. No issue.
 
I-140 revoking

Guys,

It seems that employers sometimes revoke their I-140 petition and sometimes do not. Sometimes they promise not to but then they revoke. So, I have the following questions:

1. Is there any legal requirement by the immigration law that if the employee leaves the sponsoring company by some reason (resignation, lay-off etc), the employer is required to withdraw the I-140 petition and inform USCIS on that.

2. If so, how long can they legally delay the revokation of I-140?

3. Is there some USCIS memo clarifying that?

Real Cannadian thanks, but what if I make more money because I work more hours... more than 40 but as I am salary it does not say how many hours I work (around 50-52 a week, we have many projects like 300).
Does my employer needs to specify that I work more than 40 hours a week?
