Dear GC Nation,
Is there any documentation about the employer revoke the approved I-140 such as the USCIS MEM or some articles. MY HR told me it is required that if I leave them they have to inform and revoke my I-140, is it true? Where I can find some documentation about this?
Good luck to every one...

---- NOT true, law does not requre that employer need to revoke the I-140
Where I can find some documentation about this?
----- you can go to your lawyer or ask HR to show you any document or MEMO from USCIS that says what they are saying
Good luck to every one...

Thanks Ginnu,
I am trying to find the MEMO which have mention this issues. Did any body know where I can find some of this informations.
Good Luck to every one....

HUNGURY_GC,

What ginnu said is correct. there is no rule like that. But if employer decides to cancel or revoke your I-140 there is nothing you can do. you are safe if I-140 is already approved and 6 months passed after filing I-485.

Is there any way to know if an approved I-140 had been revoked or not without going to either HR or lawyer.

You will come to know of I-140 revocation only when your I-485 is taken up for adjudication and NOID is sent to you. But once you are covered under AC21, not to worry about revocation.

cala is NOT eligible for AC21, only I-140 approved and the person was not working with the employer A when I-140 was approved and want to file I-485 without the knowlege of past employer A , if the USCIS knows that the I-140 for CALA was revoked by employer or the LC was used for other person and CALA files I-485 be ready for allegation of fraud from USCIS, becase cala will not have past employer A letter of job offer with I-485 if the I-485 is filed. Cala asked for "Tricks" in earlier post and one can guess the Intent of that person. To learn the tricks he/she should go to magician.

Thanks for the reply. Then I've got another question:
What if I ask my manager from former employer to write a letter with I-485, with some vague words like "we will hire him back in the future when opportunity comes...", since he would not really promise anything. Will that work?

-NO, becase the above lines dont promise a permanent job after I-485 approal, remember GC is based on permanent job offer and the letter has to be signed by the person in company A who sign the H1, LC or I-140 petitions for the company.if the company A has used the LC for somebody and other person has filed I-140 with LC substitution then his I-485 will get processed.and onec the LC is used the employer/lawyer request the USCIS to revoke the I-140
