AC-21: Minimizing the chance of a 485 local transfer

Hello All,

Wanted to get your tips on how to minimize getting 485 transferred to local office.

1. Does CIS "usually" transfers a case to local office only after sending out an RFE and receiving unsatisfactory info?

2. What type of cases have "usually" been transferred to local office by CIS? Does AC-21 increases the chances?

3. While sending AC-21 info to CIS, should we include audited financial statements of the new company or just a few paychecks from the new company are enough to prove their ability to pay?

---generaly 5 to 10% cases are sent to local CIS for Interview
2. What type of cases have "usually" been transferred to local office by CIS? Does AC-21 increases the chances?
------ it is up to CIS, if you update CIS that you are using AC21 they may not transfer to Local office, even if transfred no need to worry.

Ginnu, Thanks for your reponse. The only worry with a local office transfer is the wait time which in certain cities can be more than 1 yr.

Do you know if most transfers happen after a round of RFE, or are most cases transferred to local office without even RFE?

There is no pattern in transfer. I know 10 guys who used AC-21. All were laid off on same date. Some of them without even I-140 approval. Out of that 9 cases approved without even an RFE. The other case got RFE and still waiting for approval.

I heard If you marry just before applying I-485 then there is chance of transfer. Some cases are transferred just quality control purpose.

There is also saying that if you are living in city like Baltimore, Atlanta which have pretty big offices you have more chance of getting transferred. When you see the scanned results some cities appear more frequently the any other cities.

Transfer is usually meant for validate your papers. For me transfer and RFE is some random phenomena.
As some one quoted they do it to get some time or out of laziness.

Why do we need to send a W2 and paychecks along with the AC21? I am about to send in papers for AC21... but I joined the company a month ago.. so I don't have any W2 from my current company.

Apart from the AC21 letter, 485 receipt and a letter from my employer, do I need to send anything? My company already sent a letter to INS saying that I am now employed by them. I'm going to send a copy of that along with my papers.

----- it shows that you have been working/earning and can work/earn and will not be public charge, do you know if USCIS transfer the case to local USCIS office for interview they ask 3 years W-2 and recent pay stubs and tax filing papers for last 3 years. for the same reason it is better to send so they dont ask in future and it mimises the transfer chances

you need to send with your I-485 filing reciept copy
1 your intent change letter that you want to use AC21( use the section from AC21 august 2003 MEMO ) and would like to work permanently with XYZ company after I-485 approval and you job title and skill set is going to be same as on approved LC through past employer CCCC
2 New employer letter should state that they have permanent job offer for you(your name) with skil..... and job title..... after the I-485 approval

I encountered another problem yesterday. In my LC, the job duties is for a company that did digital content for set-top boxes. and now i don't work in that industry. the only common thread is that i work in C++.

Can my current company just send a very general letter of what my duties would be and that i'll be working in C++? Is that going to result in problems?

----- it is going to be future job after GC, let the employer write the same skill as on LC, who is going to ask him or going to check your work site?? and in future you may be doing the same who knows. better play safe
