AC-21 : Help

Planning to switch jobs. My details are as follows

ND : 22-Mar-2002
RD : 25 Mar - 2002

I have not received second FP or RFE so far.

Have a few questions

1) Should the salary be the same as presented in the labor petition
2) Should the position be the same as presented in the labor petition
3) The company I am planning to move is a new company started about 2 years back. What documents should I be asking my new employer to have ( ex certified tax returns )
4) Can I fill out the AC-21 or should the employer do it

The new job should be 'similar' - title/salary/description - BCIS looks at this pretty broadly.
You send the papers not your new employer. The employer's financial standing papers are helpful- tax rtns/balance sheet etc etc.

----- this is RD, ND of I-140 or I-485??? why dont you post your compleate detail of I-140 if approved or not and when you filed I-485? do you think we get dreams that the posted RD, ND is for I-140- or for I-485 or for EAD or AP???

----- For AC21 the USCIS MEMO does not say anything about salary

------Yes, same /similar for use of AC21

----- you can hire your lawyer or you can draft your Intent change letter and AC21 letter that has to be signed by employer on company letterhead, employer may also have to submit documents to show ability to pay
