Abusive husband (citizen) filed for wife's deportation

Hi,

my girlfriend ran away after Christmas from abusive husband after receiving green card in September. So, he filed a report against her for deportation. Is there anything can be done? Need help.

does she have police reports or anything else? does she have a conditional or unconditional GC? What grounds did he "file the report" on and with who? She'd better get a lawyer.

the problem is, that she does not have no police record indicated issues they've had. She was one of these woman believers not to bring family issues to the public - keep it inside the home. A lot of times she called me crying that he kciked her out the house just because he felt like it. I believe he called immigration and reported. I think he even if wants can not stop investigation as it was started. Problem I have , I have no idea myself where she is at and keep in touch only by e-mail. It is a sad story.
 
you should find out why he would file for deportation I dont think he can have her deported if she didnt do anything wrong.. he might try to argue that the marriage wasnt bonafide but if he does'nt have any proof to back that up then she should be fine
 
I think she should contact and work with a DV organization that is familiar with the immigration issues. Unfortunately, the story doesn't sound unfamiliar; the good news is she's not the only one and there are people who support people like her.

And believe or not, there are abusive U.S. citizen wives who take advantage of immigrant husbands, too.

So if it happened, we can file the adjustment status of conditional GC on behalf?

Seemingly, this is what many U.S. citizens tend to think. They think they can claim whatever they want to their government and the government will take any request from its citizens and will never do anything beneficial for aliens, regardless of situations.

But, honestly, I don't really know how fair the U.S. government is, between its citizens and aliens--any experiences, stories, observations, or opinions?

Thank you for posting this! By the way, where is your organization located? Can you recommend any other organization in different locations, if one needs?

I'm not sure if you're asking this particular organization can do it or if you're asking someone in this situation can remove the condition in general.

If your question is the former, well, I don't think I'm in a position to answer, but it sounds like "yes." If your question is the latter, the answer is "yes," there are a couple of threads that have discussed the case of getting divorced during the conditional GC period.
 
There are really two major options here. The first would be to obtain a divore and then file an I-751 based on a good faith marriage that ended in divorce or based on extreme cruelty. The other option would be to file an I-360 based on the Violence Against Women Act (VAWA). You should consult with an ATTORNEY regarding this. Only an attorney is licensed to give legal advice (a paralegal can help with forms but only a licensed attorney can provide legal advice). Additionally, I would strongly suggest that an attorney accompany the person to any future interviews with USCIS. This is more complex than just completing some forms.
 
I like to know about what is criteria to add my wife in I-140. Any help would be great.

It would be advised to create a new thread, so that others can properly see your posting. You tagged onto a thread from 2005 that doesn't seem related to your issue. Also, in order for people to assist you we would need more background information in regards to your issue. An I-140 is a petition from a company for an alien worker for immigrant status. A I-130 is the petition for an relative.
