Abuse after conditional GC

the question is very simple. If i file the 751 form based on abuse from my husband and i lived separately from him for a year already- will he ever know about that fact? will they try to reach him somehow and know the details of their life? this is not my case but my friend's. she is scared that as soon as he knows that she did it he ll try to find her and make her life muuch difficult than before. but he doesn't divorce either since he lives in their apartment and cant move out because of financial problems.thank you for any advice or links
 
USCIS will not inform the husband that your friend has accused him of abuse but your friend needs a lot of evidence to prove her allegations like police reports, affadavits from witness and the like.

thank you for the answer. but if she wins this case is it gonna be shown somehow on his record? for example "next happy girl" will marry him, does she has a chance to know about his past marriage by backgound check or somehow?
 
Not if he has not been charged with or convicted of anything. If your friend feels that the next happy girl is in danger from this guy she needs to report him to the police and press charges against him. The USCIS is not in the business of settling domestic disputes and all evidence found or gathered in the application process can only be used against you if charges are brought in relation to that application. If say the USCIS somehow found out that a sponsor is cheating on their taxes or the like they can not report them to the IRS.
 
I think there are two parts to this situation

1. If you want to have your perm GC by claiming abuse, you need to present 'evidence' to USCIS. Just saying 'abuse' isnt going to help, I guess.


2. You need to think how you are going to gather this 'evidence'. As others mentioned, evidence is usually police report filed, eye witness etc. If there is abuse, I am not sure why you are concerned about him finding out. You cannot accuse someone of abuse and expect them not to get into any trouble or know that someone (they may not know its you, if there is confidential abuse reporting) accused them of abuse. Per our legal system, accused is supposed to know what they are accused of.


If there is abuse, I feel sorry for you, but you cant have pie and eat it too. Gather evidence, get the hell out of there, report and file with USCIS appropriate documentation.
