hi
I H1b visa with one company A.
I got complete pay after every month from them.
But in feb and and 3 weeks of march i was on bench.
But last week of march i got job for a one week project.
Now I got pay check from my company A just for one week of March.

My question is if i have to transfer my h1b visa
to new company B, then will this pay check be enough to show my
last job status with company A?

Thank You

You may have to travel out of the country and re-enter if your visa get approved but doesnot come with new I-94

H1B Transfer

I did not understand about your answer.

I got last pay check for dec1 - dec 30. I got that pay check on jan 15.
But i was out of country for whole month of jan and came back on first week of feb.I got new i-94. Then i did not have work till last week of march. I worked last week of march and I got pay stub on first week of april. that is only for a week pay check.

Now could you please tell what should i do to transfer my h1 to new company? Will that pay check be enough to show my eligible status to transfer my h1b to new company.

Thanks

If officer took a look at your pay stubs and thought you were not in status due to lack of pay stubs, you'll get H1 approval without I94. In that case, you have to reenter the US before starting working for new company.

Hi
I can go outside to get new I-94.
When I will enter the usa. on the port if immigration officer ask me my current pay stubs then what should i say them?

If go first before applying H1b transfer and then get new I-94. In this
scenario , I will not need to attach my pay stubs to transfer my h1b to new company. Thats correct?

Thanks

If you have no problem to go out and reeneter, you should not have any concerns for this H1 transfer. Most of the people is concerned about pay stub as they do not want to travel.
POE officers do not ask your pay stub.

Well. they may still ask pay stub.

if they ask again for pay stub then what will be the advantage of getting new I-94.

Another thing i realised , you said in first reply if officer sees that i dont have enough pay stub, he will approve H1b but to start work I will have to get new I-94.

My another question: you can start work after getting receipt, but you get approval notice after 3 month( if it is not premium process).

So if i apply for H1b Transfer without paystub and I get receipt number, then
i can start work. But after 3 months , they approve my H1b and they will tell me i should go outside to get new I-94. Thats correct?

Thank You

I did not say you should travel before transfer.

THe point is If you could not show you were in status by providing pay stub USCIS wants, THEY APPROVE H1 WITHOUT I94, which means you have to travel and reenter.
