A/of support/I864 urgent help needed

Hi gurus

This is my uncle's employment based CP. He came back to india in August 2001 after staying / working in USA for six years. He applied for GC while he was in USA.

Now he has received appointment package from chennai counsulate. His interview is scheduled on 20th august 2004.

He has a question on affidavit of support document. on the letter he received from channai says "Affidavit of support (form I-864) from petitioner along with federal tax returns & w2 forms from most 3 recent years, job verification & bank statements"

- Here who is the petitioner? Is that his employer? Does the his employer has to fill I-864?

The petitioner for your uncle is his employer who sponsered his GC.
The letter what your uncle got is common letter for all the CP applicants I mean family based or employer based.

Form I-864 is required for the applicant who is supported by another family member in your uncles case he need to provide I-134 duly notorised filled by himself.

I don't know how you uncle is going to present the last three years of W2 when he was staying in India from Last three years check with the Chennai consulate what he need to present in that case.

I concur with VM1214 in the matter of I-864. Just a clarification that if your uncle has any dependent (Spouse, children) that he is taking with him, for that he needs to provide I-134 for each dependent.

Also for the matter of W-2 and tax returns, I guess if he was working for any one in India he can provide that, other wise, employment based GCs are based on future employment so if he is not working currently for the sponsoring company, it is okay.
