a lil too complicated

Hi everyone! I am looking for any advice you all can give me. Please give me any info that can of any use, and thank you in advance!

Here's my story:

I came to the US when I was 16 under tourist visa, but after a week of stay, my parent's petition became available so I had my change of status since then as a dependent from a worker's permit. I stayed under H4 for years. I am currently on my F1 visa due to my age cause I am now currently 24 years old and I was told that I am not eligible for the filing of a green card since I aged out. Here's the thing, I literally just turned 21 for a few days or weeks (not even a month) when my parents filed for a GC. Their GC is still currently being processed still... Now, I am not sure whether or not the CSPA covers me. Is it possible that I can appeal or something for me to get covered for the GC application?

Also, my boyfriend and I been dating for a few months now. We are sort of talking about living together and getting married. The thing is, he just filed for a bankruptcy. I don't know if his current financial issues will affect the petition if we do decide to go on with the marriage. We are still on the infancy stage of the marriage, so nothing yet is final since we both just started talking about it.

You need to consult a COMPETENT attorney and provided specific dates concerning possible CSPA eligibility. It is a complicated issue that needs professional assessment.

Hold off on marriage until you know about the CSPA issue.

An I-130 petitioner MUST file an I-864, Affidavit of Support, even with zero income. Other USC's or LPR's may file I-864s or I-864As to help out on the financial aspect. Is the boyfriend a USC? If yes, you can wait, finish school, maybe try for your own H1-B. If you do end up marrying a USC in the future, then you will be able to adjust some day.
