7th Year H1B Extension - Have Extra time on the H1B petition

Hi,
My 6 years on H1 ends on May 2006. But my current H1B petition has an extra 1.5 years.
I have a pending labor petition filed in 2002. When I approached my lawyers for the 7th year extension, they have suggesting not to apply since I already have an extra H1B time of more than 1 year in the Petition.
Is this Ok ? Has anyone been through this scenario ?

INS oversight can not be taken to your favor. You must ratify this issue by applying your extn (7th yr) once your 6th year physical presence is over.

That is what I am worried about. But my lawyer insists that it is not necessary for 7th year application. I don't know what to do.

You have to pay for it , even if your attorney makes mistake on behalf of you.
