7th Year Extn

HI All,

My 6th year H1 expires in Dec 2004.

I have filed my Labor in 2002 which got approved in June 2004. I have filed my 140/485 concurrently in July 2004.

I would like to file for my 7th year extension. Would i be eligible, as i read somewhere that for filing for 7th year H1-B extn we need to have I-140 pending for more than 365 days. Please advice what my best options would be.

You can apply for 7th year extension based on the fact that I-140 is apllied and pending and the labor was filed > 365 days ago.

What If I-140 is approved and I-485 is not yet applied. can we still apply for the 7th Year extension during this period. If so, do we need to produce a copy of I-140 Approval ?

NO, you need I-140 pending or I-485 pending in your case, if your I-140 is approved then file I-485, once you get I-485 filing reciept use the I-485 pending reciept for 7th year H1 extension
If so, do we need to produce a copy of I-140 Approval ?

I am in the process of applying for my 7th year H1 Extension thru my company. In this case, I would like to know what should be answered for a question in the I-129 part 4 Processing Information:
Have you ever filed an immigrant petition for any person in this petition?

Scenario: My husband already applied for the I-140 and I-485 for me thru his company and we are with separate employers.
