7Th year extension

Hello , My H1b 6 year is about to get over in May'06 and my employer has filed for my 7th year extension based on my labor application which is pending for more than 1 year.My question is , if I don't get my 7th year extension approval before my I-94 expires, do I have to leave the country in that case or I can legally stay in US till I get any decision from USCIS on my application.

H1B 7th Year Extension after Labor Approval

I need some expert advice on H1B 7th year renewal. My 6 years of H1 is expiring on June 14, 2007. My labor (PERM) was approved in the first week of June 2006. My question is this: my company has not yet applied for I-140. Is there a rule that states that I-140 must be pending if Labor is approved (and 365 days has passed since Labor was files) to get a 7th year extension?

I have searched this forum and others but none seem to answer this question. Can you please help me? :confused:

So far, there no such rules, but I recommend to apply for I140. If your I140 got approved, you can apply for 3 years H1 extension.
