7th year extension from new employer based on LC approval from previous employer

Hi

I got my LC approved from my previous company and later on changed job. Now with current company I have only 8 months left and I was wondering if I can get 7th year extension based on previous company's LC approval.

Any help will be appreciated.

You can

You can extend with your old company LC. But make sure that they(old company) will not revoke the application.

It's also unclear what will happen if the old employer substitutes another employee on this LC. The rule permitting a 7th year extension based on a pending or approved LC is much newer than AC21, and we do not have implementing regulations for either.
 
My last employer filed chapter 11 after getting mu Labour approved and I joined my current employer, applying H1B transfer. I have only 8 more months left on H1.

1. Can I get 7 th year H1B extension based on my original petition ? If so what documents I need for that.

2. There is a chance that a new company being formed using the assets of my old employer and the original employees will be rehired. If that happens can I continue with the GC processing by filing 140 based on origianl labour approval ?

Goku, interesting scenerio. Slightly similiar to mine and my company has gone ahead and filed for an extension.

This is what my scenerio is :

My last employer was a telecom giant (name starting with 'N'). It sold the assets of my division to my present employer.

My present employer filed for my labor in July 02 while my prev empoyer (the telecom co) had filed in 2001.

But now, my H1 expires in March 03. Therefore the labor filed by my present employer cannot be used to get th extension. So what my company has done is filed for an extension showing the labor cert receipt from my prev employer (So therefore I feel your company can go ahead and do the same).

My present employer sounds quite confident that the extensions would go through. However, there is a problem here, the labor from the prev co hasn't been approved (there was an NOF, because of layoffs at that co). If at anytime, the labor from my old co gets rejected, I would lose the H1 extension.

Any comments on this Jim Mills ? I would really appreciate it if you could comment..
