Hi,
* My Friend applied LC in May 2002, thru his employer.
* His actual H1B1 6 years period is ending in Sep 2003.
* He went to India for Vacation in May 2003.
* His LC is Approved in Juner 2003.
* After 1 month Vacation he applied for stamping in US Consulate, he didn't get stamping. The Reason[221g].
* Can he file the 7 th year extension outside the country.
* If not when he can come into US in H1B1 Visa.

What was the documentation missing that triggered a 221g refusal?
Yes, your friend can do a 7th yr extension while waiting outside USA. But if there was some other documentation that has been requested , a pending 7th year H1 application will not get your friend a visa.

My Friend was told this reason that

"he need to produce a new I-797B for stamping or the employer need to file a fresh petition for me"

1. My Friend got I797 Paper which is Valid upto Sep 15 2003.
2. The Labor got cleared in June 2003.
3. Does it mean the employer need to file 7 th year h1b1 extension?

I797B? Most probably they just need a consular notification, can be done by filing I824. however I824 takes time. I would suggest both I824 and 7th yr h1.

I797B, that is th counsling Officer needs the fresh H1B1 Petition.
1. Is he able to come in H4?
2. If No When he is able to come in H4/ H1 visa. It means
May 2004 / Sep 2004.
