7 th year extension (please help)

Hi all,
I live in atlanta.....
My six years end may 9th 2004 . But my last extension was wrongly done till nov 9th 2004. My lawyer filled my LC in may 2nd 2004. But i didn't get any recipt from my lawyer ......he says he don't know about any recipt . According my lawyer my LCA is pending at the US DOl.
Am i able for 7th year extension ? What can i do about my visa stamping ? Should i request for recipt from department of labour ?
And...
My wife is pregnant by 6 months .If for some reason I do not qualify for the 7th year extension, what options do I have? Can
we get extension for a couple of months because my wife will not be in a position to travel at that time?

I was in your situation before, I mean 2 yrs back.
7th Yr extension is possible. My case scenario was like this.
They wrongly gave me the visa as Nov 2002 instead of March 2003. So My lawyer applied for the correction and I got an ammended/new approval notice dated until March 2003.

My LC was filed on Feb 22 2004 1 Year before the xpiry of the 6th Year h1. Based on my LC application, Iam getting 1 year increments from March 2003 onward. I mean I have 2 approval notice which asid, March 1st 2004 (expired 1 days before) and the 8th yr extn March 1st 2005.

Your Lawyer should have all the receipts that he ssent to the state labor clearance. If he does not have he needs to take the initiative in calling htem up and getting the receipt number. I have a copy of the State department receipt letter/ack letter saying that they received my case on Feb 22 2002 and is under review. This is enough for ur 7th yr extension.

My lawyer filled my LC in may 2nd 2004
----- how your lawyer can file LC in MAY 2004?

If your LC filed in 2nd may 2003 then you are NOT qualified for 7th year H1 extension at this time. You can file 7th year H1 after 2 may 2004 with evidence of LC filing and evidence is receipt from SESA or SWA that your lawyer receives once LC is received, if no receipt is received for LC filing from SWA or SESA lawyer can ask for the receipt from SWA or SESA they will send it in 10-15 days
 
I think our lawyer doesn't want to give us LC filing recipt . Can we personally ask for the receipt from SWA or SESA ? If yes what will be the procedure ?

If your employer asks the LC filing receipt from SWA or from Lawyer you will get it. Better ask your employer to contact the lawyer who filed LC
