I-130

Shelbean,

It’s funny because received date that my wife filed for me, is the same September 23, 2004. How fast your case is going to be processed depends upon which District Office did you send your papers. To see the processing dates you should check the following site > https://egov.immigration.gov/cris/jsps/ptimes.jsp
It can take anywhere from 6 months up to 2 years. Also, calling USCIS will not help a lot because they will just tell you probably, when you can expect your case to be processed or refer you to the site I gave you.
Good luck!
P.C. I file in Washington DC (Arlington) office, and wait there is 13 months.

i 130

hi thanks for reply. the case is being processed in california. yes i know about the processing dates. they are currently processing recieved dates in feb of 2005. that doesnt seem fair to me. why are others being worked on, when mine has not had a descion yet. im american citizen, husband is british. we have 2 children. hes not in america. and i live half here and half there.

My wife file I-130 for me that same week (September 25,2004). I haven't heard anything either. I live in North Carolina. I called USCIS but they don't help at all. They give the wrong info all the time. My case have not move in 7months and I'm starting to worry.
Anyone know which USCIS office handel I-130?

is anyone else in this postion?

hi everyone. do the processing dates really not mean a thing? is there any others out there whose case has not had a descion and the office they filed at are currently processing cases whose recieved dates are months beyond yours? Does anyone know what we can do? im wating on a response from one of my senators. i wrote to debi stabenow. I also call uscis at least 4 times a week. sometims i get someone who transfers me to a specialist and a couple times an immagration officer? Is that what usually happens when you all out there call them? thanks and best wishs to all.

wor

you can tell which office has your case by the three letters in front of your recipt number on your notice of action.

hm...

It seems like everyone filed at the same time :) Calling USCIS 800 number, doesn't help at all, that is the same thing what happens to me all the time, transfer to 'professional' than transfer to immigration officer, and i still don't get answer on my queston. I didn't know that upon receipt you can figure out which office is taking care of your case. Mine is 'MSC' which probably means Missouri Service Center, or whatever...
Always some confusion...

youre right, bussiness

yes, msc........means your case is in missouri.......that is where my k 3visa case is pending

called uscis

i called uscis number today........i just ended up in tears....no one has any anwsers..how is that possible? how can there not be anyone on the other end.......or any other number that i could call for some direct answers. How is it possible that no one knows why my case has not had a decsion in 7 mths?

Dear ShelBean!
Please do not beat yourself up. Find an immigration attorney, here is a link to a referral service:

Maybe there are some valid reasons keeping your I-130 pending, or not, who knows...
But guessing and stressing out so much won’t do anything good not for you not for your four children.
I understand that it is very hard to be torn apart between two countries, uncertain about the future. :(
I and a lot of other people on this board feel sad for you and your situation. You asked the same question over and over, but nobody has the answer for you. :(
Please hire and attorney and let him/her handle it.
At least go to the initial consultation.
He or she might find some answers for you, some constructive advice. He or she will make an inquiry on your case if you ask them.
Best of luck to you, ShelBean! Sorry can’t be more helpful.
Jane. :)

im sorry i asked the same question over and over again. I thought the more i posted, the more people would have the chance to see it. I thought thats they way it worked on here. Ive never been to forums before. Im sorry again. I have emailed Rajiv S Khanna and Im waiting for thier response. Thank you for the link also.

Shelbean, Hello!
You don’t have to feel sorry or apologize. We all here to help each other. Your case is complicated and you do need a legal advice. I just gave you a suggestion, seeing you pounding over the same question. I wish you some good progress on your case soon!
:)

Hi Shelbean,
I feel the same way. It is hard when you can't get any answers. I think the only thing we can do is to wait. If you are truly marry and have all the document to prove it, you don't have to worry.

I have a friend of mine in Florida who file his case one month after I filed mine(I filed in Sep and he filed in Oct.), his case got approve in two months. He got his con. GC in Feb. I was shocked. Why???? All I can do to wait

Now that you guys are all whining about a 7 month 13 month wait, let me tell you, my I-130 for my wife was filed in Jan, 2001 and is still pending at TSC. Now can someone tell me if that's normal? CIS website says TSC is currently processing 1999 I130 cases. Go figure.

jzlthssw,
I have forgotten your case. Have you filed I 130 as a US Citizen or GC holder? If you have filed as a GC Holder your case is normal. This people has filed as a US Citizen which shouldn't take this long. That is why they are worried.

Try something beyond calling 800 number.

ShelBean, Wor and Others.

If I were in your position, I would definitely try something more than regularly callling 800 number. I have called that same number many times and not for once got any useful information. Here is what I suggest.

1. Make an infopass appt to a nearest local DO or even ASC (if local DO is more than couple of hours of drive). They probably can help you more. Also visiting local DO creates "activity" on your file and might help move it forward. No promises but worth a try.

2. In general Congressman are more useful than senators. Try local congressman. I would even recommend visit their office. Once you are there, urge the staff to call USCIS office and get some answers. Not a easy thing but you might lucky.

3. Write a letter to local DO requesting status inquiry. Send it by certified mail.

Although I am in a different situation, I feel your pain.

Goodluck and keep faith.

My bad! Yes, the original I130 was filed as a GC holder 4 years ago. Just became citizen, so I wrote TSC to upgrade that I130 (4/5/05). CIS e-mailed me and said they've "responded to your request for information regarding your I-130 case on 4/15" and I'm waiting on the snail mail.
Can someone tell me whether EAD and advanced parole can be approved before I-130 is?

Thank you all for your input. Reading other people stories and exprience really help. Good luck to you all. I'm going to make an info pass app. this week and see what those USCIS people are up to. I will tell you guys what happen next. Let's keep this thread going :) :)
