6 year Visa limit expiring ... till when can I re-enter ?

Hi,

I was with company A. I left them in July 2004 but their H1B is valid till May 2005 ... I joined company B who just transferred the H1B to them. (I haven't stamped this H1B yet ...)

I am processing my GC thru company C, the Labor of which has been pending for about 20 months ...

I am planning to visit India in Feb and to be back by Mar end ... Since Company A's H1B is valid till May 2005, Company B's attorney told me that I don't need to actually get their (Company B's) H1B stamped ... Is this correct ?

I intend to apply for 7th year extension thru Company C after I come back from my visit to India ...

The question now is : is there a time limit for me to be back in US to apply for the 7th year extension ? ... I mean, how many days can I have left in my current Visa before I can enter USA ? ...

Since I do have valid H1B stamping from Company A do I need to take Transit visa at Frankfurt ? ... (I am going via Frankfurt) ...

Yes, you do not need to get company B's visa stamped. Coming back by March end is safe enough. You can do 7th year ext filing once you come back. Do remember to carry company B's H1 approval notice and few recent paystubs also for re-entry.
