485 Without W2

Guys,

Is there any way to go thru 485 without w2. I mean do they really need tax returns for GC?
I am on H1(valid) and dont have tax returns for last 2 years. One company(other than H1 company) filed my Labor and I-140 and it has been approved. Now they are going to file 485. How much chance is there for success or is there no chance at all without tax return?

pls guide me!

GC id for future employment. There is no problem not having W2s. You don't have to be employed before GC approval. Your sponsoring has to have intention to hire you permanantly and you intend to join them at the time of ajustication.

The only reasons I can think where a W2 would be required during the 485 process is a) if you are sponsoring a derivative applicant (spouse), or b) you get an RFE asking for tax returns and W2s to demonstrate status consistent with what you put on your application.

If you are on an H1, and presumably working, is there a reason that your employer did not furnish you with W2s? Also, why would you not have submitted tax returns if you were working?

thanks for the light! yes I am not working for last 2 years so I dont have tax returns/w2 for last 2 years. My only doubt is about 485/adjustment of status , are they really going to ask about my tax returns/W2 at 485 as a proof of my legal status in this country. I have tax return for only 2000/2001, not after that. My H1 is still valid for next 2 years.

This means you've been out of status for over 180 days (and your H1 is not valid), so unless you have a PD of 4/30/2001 or earlier, you cannot adjust status.

They might. You should consult with an attorney to see what your options are. There's no point wasting all the money on an I-485 if you are eligible to adjust status.
