485 petition Rejection for dependents - TSC

Hi All,

Iam new to the forum .

I filed my 485/EAD/AP for my self,wife and two children (ages 10 and 6) at Texas Service Center and our applications were received on 12/28/04, myself and mywife got receipt notices for 485/EAD/AP.

But for children we received rejection notice with two reasons
1) BioMetric fees not necessary (by oversight I have included finger print fee for kids)
2)Kids need to sign on 485 ( As advised by my company , I mentioned in 485 application that "form prepared by father as my kids are minors")

I have resent the applications with new checks and have my kids sign 485 . But texas service center returned the application with a new reason
1) A Visa number is unavailable at the present time

Along with it they enclosed a letter saying that visa application returned because TSC does not process this type of application ,file the application at CIS offices close to your place of residence.

My question : Is it correct on part of INS to reject dependents 485/AP though the primary applicant was issued receipt notice for 485/EAD/AP

How to fix this issue ?

--your mistake as you were filing before december end, you should have filed through lawyer so that no mistakes

---yes, becase of the mistakes done by you

though the primary applicant was issued receipt notice for 485/EAD/AP

How to fix this issue ?
----I dont think they will accept I-485 till your PD is current, you need legal advice and contact good lawyer, if you are on H1 try to file your H1 extension( you are eligible for 7th year H1 becase of pending I-485) and file kids H4 extension on time and you need to maintain H1 status so that your kids can get H4 extensions

this is a news to me
why shuld kids sign on 485 it shuld be the signature of legal guardian.

When I submitted the forms, i was never asked by my attorney to submit childs signature on 485 form, my kid is 6 year old.

U need a lawyer to handle ur cases. For minor kids, I don't think u need their signatures, but I am not sure. Talk to a good lawyer and he/she can help u. Yes, 485 cannot be processed until ur pd is current. If u don't understand instructions or immigration law, u need a good lawyer.
