485 filing, why send extra documents???

***3 year tax returns and W2s
***form 134 or something

I was going through the official requirement and they dont need any of the above...

they just need copy of the page containing non-immigrant visa from the passport....

do we need to send extra information???

this is not a do or die question, hence we dont need to sweat a lot.....extra information can be thrown away but if we dont send and they want it they will issue an RFE....which will delay the case...

but on other side will they not request all documents they think is important.....i mean do they have time to go through all the pages of our passport.......i am sure they dont trust anything unless it has got some reference to their system...

opinons please??

Because a lot of lazy or uninformed attorneys say so, and a lot of people trust an attorney's word more than USCIS, the law, or even God. :)

The only thing you will need is the affadavit of support for your dependents, the I-134 or I-864 (whichever one you use for EB depednents, I can't remember which one offhand). The tax/passport stuff isn't necessary; I never submitted passport pages or tax returns or W-2s. They did ask for my latest return at the interview, but that was more out of rote than anything else. The officer just glanced at the income field to make sure it had some relation to my salary, and then just tossed it into the file.

straight from form 485 instructions:

Submit an Affidavit of Support (Form I-864) if youradjustment of status application is based on yourentry as a fiancé(e), a relative visa petition (FormI-130) filed by your relative, or an employment based visa petition (Form I-140) related to a business that isfive percent or more owned by your family.

I don't remember which category exactly you were gonna file under, but I submitted my EB-1 EA WITHOUT I-134 (or I-864), W-2s or tax returns. Never received any RFEs, probably because EB-1 EA is more achievement-based and there are no income requirements.

I did, however, include all pages of my passport and all previous I-797 approval notices, exactly for the reasons Unitednations mentioned. As far as passport, DO include at least the visa page and the biographic/picture pages (those preferably ENLARGED and in color).
