485 experts..can anything be done before 485 for first/middle/last name confusion

Hello Ginnu..RealCanadian..

Is there anything we can do before filing the 485 for the confusion we have with first/last and middle name.

In our case, the passports have one combination,H1s filed have 1 kind,i140's have a different kind combination..

is there something we can do here to show as the a.k.a ..also known as kind of procedure here to show INS so we can avoid future RFE's..

Also..have you all come across some real cases where GC was approved when the applicant is not employed with the sponsor during filing of 485..

In our case, the passports have one combination,H1s filed have 1 kind,i140's have a different kind combination..
------------------provide the deails, how name appear on passport, what is on H1 visa stamp, what is on I-94 and what is on Birth certificate.

-------------------------Can submit 2 affidavits from your parents and one affidavit from You. all depends what is problem with name and you did not provide details

My apologies for not being Ginnu or Canadian, but here's my opinion:

1- Forget about the H-1 papers for this matter - you are filing a brand new application and what matters here is your I-140 (which the I-485 is based on) as well as your passport/birth certificate.

2- I am understanding that your name is spelled the same way in your passport and your I-140, but in different order. You are saying that your name in your passport is Shlomo Ahmed Steinberg, whereas it is Ahmed Shlomo Steinberg on the I-140 (or Ahmed Steinberg Shlomo). If that's the case, there is probably not much to worry about. I had a somewhat similar situation (middle name is spelled out on I-140, but only have an initial in the passport). So what I did was list the different naming schemes under the "Other names used" category on the biographic form G325a. I suggest you do the same.

3- As for employment, what matters is that you will work for your sponsor once you get your green card. Where you were working before you got the green card shouldn't matter as long as you begin working with the sponsoring employer once you get your green card. If you are called for an interview once your green card is approved, you will have to provide evidence of upcoming employment with the sponsor. I assume this is EB-3 or EB-2 (not NIW).

jko274 : that was the same situation we have,the attny filled in the 'other names' of the g325a form..

but will that suffice or is there any thing more like notarizing, affidaviting need to be done..I read somewhere that we need to get in notarized thru a court etc..

surname has our 'familyname', given name has 'firstname middlename'

i140 has a name as

middlename, firstname familyname


Do we need to follow the sequence of the i140 in the i485..
honestly we should just have a first and last name and trim away the rest of the name..
 
Ahh you must be from the South.... !!

Well, I must first divulge that my I-140 and my I-485 (along with my wife's I-485 as a derivative) have not been adjudicated yet. However, our I-765 and I-131 (filed concurrently) have all been approved with no problems.

On my passport, I have: Full First Name / Two Middle Initials / Full Last Name.
On my I-140/I-485/I-131/I-765 I filled in: Full First Name/Full Middle Name/Full Last name.

I did, however, write the name as written in my passport on the G325a.

On my wife's passport, she has: Full First Name / Two Full Extra Middle Names/Full Last Name that includes an apostrophe.
On her I-485/I-131/I-765: Used just Full First Name / Full Last Name (without apostrophe) only. Again, wrote her passport name on the G325a.

And I didn't think anything of it. I still don't. Moreover, even though I wrote my full middle name on the applications, the receipt only had a middle initial (since that's USCIS standard).

I would be very very surprised if I got an RFE because of this. Again, the EAD and AP have been approved without problems, and I don't expect any problems with the I-140 either. The I-485...well no, I don't expect a problem there either. Especially as 1- the G325a has the alternative information they need for FBI name checks and 2- the only write the middle initial on the actual approved document anyway.

Lastly, yes, for consistency I would type your names on the I-485 exactly as it is on the I-140 that it is based on. I would also write the name as it appears on your H-1B documents as an alternatively used name on G325a biographic form as well, since you have officially used that name with USCIS before. If you ever decide to apply for citizenship in the future, the citizenship application (N-400) will allow you to change your name on the naturalization certificate if you don't want it to look like your green card; that won't be a problem.

As a side note (and not to distract from anything I wrote above), you might be interested in reading this post from another forum on this website, especially my post at the end. This is not related to what we're talking about here, though.

---------------------- on passport it is correct. if your full name is RAM Kumar Sharma then on passport surname will be Sharma and given name will be Ram Kumar
i140 has a name as

middlename, firstname familyname
----------------------on I-140 it should be SHARMA (last name), Ram Kumar

Do we need to follow the sequence of the i140 in the i485..
--------------no on I-485 write your Last name or Surname SHARMA , given name :RAM middlename: KUMAR
*** write the same on G325 and also provide other names used on G325 and attach a sheet and explain your Full name and also explain that your Last name is..... Given name is... middle is.... sign the sheet with your full name and date
honestly we should just have a first and last name and trim away the rest of the name..
