My current I-140 filed in Sep 2003 is still pending. As a backup, I am thinking of starting another GC process with another employer.
My questions are:
1) If the new company has an approved labor, can they file the new I-140 by premium processing ?. They have the original of labor (not copy).
2) I understand that one can get 3 yr H1 extn if the labor is approved + I-140 is also approved. Is this true even if the labor is "pre-approved" ?
