I have a question. If the person (with asylum status) who lived in USA illegaly before applying for asylum travels outside of USA with RTD will it trigger 3 or 10 year bar when he tries to re-enter USA???

No! Asylee category is exempt. That is how RTD becomes powerful.

Note for National Passport Advocates:

You might be in trouble if you are traveling on your renewed NP under above circumstances. However you won't have any problems with RTD.

The law often carves out a special category for asylees. And yep using NP is stupid.

I just called USCIS and talked to Officer (not a cust service rep). He stated that it's ok to use NP but not good to renew it for asylees and refugees. He stated that people who falls under those categories havt to get RTD before departure. Please stop the speculation about using NP.

Bottom line:

It's ok to use NP untill it's exp date.

Do not renew it.

U have to have RTD when u travel. RTD is like reentry permit for us.

What if they'll ask u to bring your national passport for the interview in INS? The only answer u can give them is that u've lost it which is suspicious. What if they'll check with the embassy of the country u r from?

Thats right. They can ask u for your NP which u used when came to USA initially. Why would u want to renew ur NP anyway. I used it while it was good and that was it. U have to have RTD anyway. RTD works fine to travel to most of the countries.

Now I’m confused totally!!!!! I thought that we use our NP for traveling around and entry to other countries and we use RTD FOR RE-ENTRY TO USA ONLY

Yes u can do it. I found out from Immigration Officer. But when ur NP will be expired DO NOT TRY TO RENEW it. They don't like when refugees do that. Mine expired 2 years ago, so I'm using RTD for both VISAS and of course reentry.
