2yr HRR J1 extension/H1

I have a 2 year HRR to be fulfilled. I have already applied to obtain No Objection certificates from India. My visa is valid until may 31st, 2008. I can get it extended for another year so that after obtaining NOC I can initiate the process of obtaining waiver at DOS.

I have also been given a choice to switch from J1 to H1 instead of J1 extension at my current work place. I was wondering if someone knows whether I may apply for H1 visa instead of J1 extension and still be able to obtain waiver for 2 year HRR while being in US. Please advise. Thanks.

You can not obtain H1 until you either get a waiver or fulfill the 2yr HRR. So your only option - J1 extension.

Just remember that you can't get the extension or travel once your waiver is pending. So first apply for the extension, then once you get it apply for the waiver.
