2nd Interview but not completed the case yet

:mad:I need your help. I have completed my interview on April based my 3 years marriage to my USC husband. At the end I got the letter saying a decision could not be made. After few days I saw RFE on the web site case status but never received any letter by mail. Few weeks ago I saw case status saying "Case sent for a standard interview at DO." I got an another interview letter a coupld days ago and went to attend the interview. After waiting 2 hours, the IO called me to his office and said they don't have enough people to work on my file on that day and he has nothing to do with my file because somebody already went through my file and I have passed the English and Civic test. If they need anything they will send me a notice, sorry. What should I do? Was the 2nd interview notice was a mistake? The officer was in hurry and did not talk to me than the above. Should I worried since it already over 5 month after the interview? Your replies in this matter will be highly appreciated.
 
I have given all required docs such as 4 yrs tax transcript, Checking and saving account statements, utility bills, photos. I don't know why I am not getting a decision.

Did you get N-652 form, signed phot, and signed last two parts (Part 13 and Part 14) of N-400 during your first interview?
If you did all these, you may not need a second interview

Since by USCIS definition your case is being "actively worked on" then the government has 120 days from the date of your second interview to issue a decision on your case if you did not get a N-652 at the end of one of the interviews.

Yes, I signed my application and photograph and received the N-652 saying that a "decision could not be made."
I just wonder why the NBC issued another interview letter. The officer was surprised to see my 2nd interview letter. He looked thorough the file and said everything is in order. Is my file waiting for supervisor who was not available at the second interview day? If they don't have enough people how did I get the letter to show up for the 2nd interview? I am tired waiting.

I don't think you need to worry. Just wait patiently but regularly
call USCIS hotline and also make an infopass appointment if necessary. I believe a "decision can not be made" interview result is common
for three year marriage based applications even if everything look
normal.

In the meantime, try to further collect all sort of documents in
case USCIS ask for them. Keep all bank statement for your joint
accounts, utility bill with yoru spouse as co-user, or whatever
you think are related to yoru marriage.

I am also going through same problem .

We still love and live together. There is nothing unusual but I am worried because it has been a long time, 5 month after I passed the interview. If they want something I am ready to send.
 
If it were me, I'd start thinking about a lawsuit. From the second interview, it appears that there was no reason that your file sat around for 5 months without any action being taken.
 
You don't need to hire a lawyer. You can do it yourself. All you'd have to pay is the filing fee. I'm not sure how much that is probably less than $200.
 
I don't think you should worry too much for now at least. The positive thing with the second interview scheduled was that at least now you are likely to have the case file moving again. Looks like after the 1st interview the file may have just been gathering dust somewhere :D .

If you do not hear from USCIS within 45 days or so, schedule an infopass appointment and speak to an officer. They may be able to direct you on how you should proceed. The lawsuit option should be your last resort but I believe USCIS has 6 months from your interview to make a decision (in your case I am not sure if the period will be counted from your 1st interview or the 2nd interview). If all else fails you may soon be eligible to file based on the 5 year rule :) which may be a lot simpler.

However I think you should hear back soon regarding your case result.
 
Section 336(b) of the INA states that if USCIS fails to grant or deny an application for naturalization before the end of the 120-day period after the date on which the examination is conducted, the applicant may apply to the district court for the district in which the applicant resides for a hearing on the matter. The court may (1) determine the matter or (2) remand to USCIS, with appropriate instructions, to determine the matter.

You could wait a little while before doing anything more. I suppose it depends on how badly you want to get your citizenship.

I wouldn't wait to apply under the 5 year rule. If you're eligible now you should be able to get your citizenship. It'd be unfair on you to wait just because USCIS doesn't want to do their job.

Hopefully your second interview will prompt them to approve you and schedule you for an oath.
 
There was not a sencond interview. I went there with the 2nd interview notice and the IO just put that on my file saying that they don't have enough people to work on that day, they will let me know by mail. I believe it was a mistake sending me a 2nd letter. I got that from NBC.
I am eligible to be a citizen under the 3 years rule. I gonna stick on it.
 
I have called the costomer service today and being told that they will send a service request for me and it will take 30 days to get the request in the district office? Any idea why it take 30 days?
 
The delay is probably due to the large number of applicants. You could schedule an infopass appointment to see if you can get them to do something with your application.
 
I need help to send a letter to USCIS

Dear friends, It has been six month after my first interview (A decision could not be made) and 3 weeks after the second interview letter. I was trying to make Infopass but it doesn't meet with my work schedule. I have already took a lot of days off from work and can not take an another day off. Can I send a letter with more current documents related to my marriage to the local office? I am waiting for a long time. Its almost 6 month. My English also not good. That's the reason I need you guys help. Would you please help me to write a letter asking decision?
 
Marlia: I don't think you need to send more documents regarding marriage when they didn't ask for any - might even look strange if you do that.

-did you call USCIS and try to talk to an IO (2nd levels customer support); when you talk to 1st level TELL THEM that it has been more than 120 days and you need to talk to an IO
-I know it's difficult with work etc, but the best thing IS to make an Infopass appt.; Nothing will give you more peace of mind.
-you're past the 120 days; you have a GREAT reason to have an infopass, or apply for a hearing. It's your job to make an appt, even if it's hard with getting off work - you just need to do that.
-your English is much better than some I have seen on this board. If you need to talk to an IO on the phone, or before you're at infopass, just write down and practice exactly what you need to tell them - it might help you not be nervous about speaking- try to anticipate/guess what they can ask - prepare a clear response - and practice.
