I need your help. I have completed my interview on April based my 3 years marriage to my USC husband. At the end I got the letter saying a decision could not be made. After few days I saw RFE on the web site case status but never received any letter by mail. Few weeks ago I saw case status saying "Case sent for a standard interview at DO." I got an another interview letter a coupld days ago and went to attend the interview. After waiting 2 hours, the IO called me to his office and said they don't have enough people to work on my file on that day and he has nothing to do with my file because somebody already went through my file and I have passed the English and Civic test. If they need anything they will send me a notice, sorry. What should I do? Was the 2nd interview notice was a mistake? The officer was in hurry and did not talk to me than the above. Should I worried since it already over 5 month after the interview? Your replies in this matter will be highly appreciated.

If you did all these, you may not need a second interview
Since by USCIS definition your case is being "actively worked on" then the government has 120 days from the date of your second interview to issue a decision on your case if you did not get a N-652 at the end of one of the interviews.

I don't think you need to worry. Just wait patiently but regularly
call USCIS hotline and also make an infopass appointment if necessary. I believe a "decision can not be made" interview result is common
for three year marriage based applications even if everything look
normal.
In the meantime, try to further collect all sort of documents in
case USCIS ask for them. Keep all bank statement for your joint
accounts, utility bill with yoru spouse as co-user, or whatever
you think are related to yoru marriage.
marlia can you plz tell me about your case background are you still married and living with your us citizen husband?
I am also going through same problem .

I don't think you should worry too much for now at least. The positive thing with the second interview scheduled was that at least now you are likely to have the case file moving again. Looks like after the 1st interview the file may have just been gathering dust somewhere 
.
If you do not hear from USCIS within 45 days or so, schedule an infopass appointment and speak to an officer. They may be able to direct you on how you should proceed. The lawsuit option should be your last resort but I believe USCIS has 6 months from your interview to make a decision (in your case I am not sure if the period will be counted from your 1st interview or the 2nd interview). If all else fails you may soon be eligible to file based on the 5 year rule
which may be a lot simpler.
However I think you should hear back soon regarding your case result.

Section 336(b) of the INA states that if USCIS fails to grant or deny an application for naturalization before the end of the 120-day period after the date on which the examination is conducted, the applicant may apply to the district court for the district in which the applicant resides for a hearing on the matter. You could wait a little while before doing anything more. I suppose it depends on how badly you want to get your citizenship.

There was not a sencond interview. I went there with the 2nd interview notice and the IO just put that on my file saying that they don't have enough people to work on that day, they will let me know by mail. I believe it was a mistake sending me a 2nd letter. I got that from NBC.

I was trying to make Infopass but it doesn't meet with my work schedule. I have already took a lot of days off from work and can not take an another day off. Can I send a letter with more current documents related to my marriage to the local office? I am waiting for a long time. Its almost 6 month. My English also not good. Marlia: I don't think you need to send more documents regarding marriage when they didn't ask for any - might even look strange if you do that.
-did you call USCIS and try to talk to an IO (2nd levels customer support); when you talk to 1st level TELL THEM that it has been more than 120 days and you need to talk to an IO
-I know it's difficult with work etc, but the best thing IS to make an Infopass appt.; Nothing will give you more peace of mind.
-you're past the 120 days; you have a GREAT reason to have an infopass, or apply for a hearing. It's your job to make an appt, even if it's hard with getting off work - you just need to do that.
-your English is much better than some I have seen on this board. If you need to talk to an IO on the phone, or before you're at infopass, just write down and practice exactly what you need to tell them - it might help you not be nervous about speaking- try to anticipate/guess what they can ask - prepare a clear response - and practice.
