2nd fresh(6yrs) H1B visa

Hi!

I have the following question:

If a person has to go back to India without completing the "H1-6yrs limit", then does he need to wait till the end of the "H1-6yrs limit" plus an additional 1 yr to come to US on a fresh(6yrs) H1B visa?

if you are out of US for 1 year you can get H1 for fresh 6 years
if you exit US on Jan 2004 then you are eligible for fresh 6 year new H1 on Jan 2005

In the above example:
Is the person eligible for fresh 6 year new H1 on Jan 2005, eventhough by Jan 2004 the person uses only 5 years of his/her current H1B's 6 years?
