2010dv-lottery winner and travel

My case:

I am a 2010 DVlottery, AF0008XXXX.
I have already sent back the forms to KCC. I have chosen the consular procedure (CP), since my number sooooooooo high, and I am a student (F-1) here in the US.
Now, I would like to go on vacation to my home country in december.

My question:

Do you think, I am going to have problems entering the US after my stay in my home country? Filling and sending back those forms (DS 230 and DS 122) to KCC have already jeopardize my F-1 status?:confused::confused::confused:

I really need your advices Guys!!!
 
technically by sending the forms you have filed an immigration petition.

f1 is a non immigrant visa.

one if the requirements of f1 is that you have NO immigration intent.

i would advise against travelling out of the US except for the purpose of the CP itself.

I am no lawyer though, talk to a lawyer if you want legal advice.

That's what I was thinking about!
But for me, it was only after filling the AOS forms that someone is considered filing for a petition!!! Am I wrong?

No, AOS and CP are just two paths for a DV winner. But it is the paperwork which you send to KCC that demonstrates your immigration intent. After all, your DS-230 is an application for immigrant visa, so what else can it mean?
 
I'm not sure about the right answer but it doesn't sounds fair if you can enter the lottery and win and than being labeled different just because you won and at first had a non immigrant visa...if you didn't win you wouldn't stay here...it isn't like you would stay here illegal if you didn't win. To me it can't be true that they would treat you almost like a criminal for just entering and winning...I would call a lawyer and ask for advise.
