Hi my company filed for my H1B in masters premium quota (thats what they say). I did not get any notice approved / not approved. I asked for the application number and this i the reply that I received
"We do not have such a number for your case. When a case is receipted in for adjudication after selection in the lottery, a receipt number is issued that can be checked on the USCIS website. However, no such number has been issued for your case – for cases not selected in the lottery, it is normal not to have a receipt number"

Is there any way to know whether the company even filed for my visa. Thanks for allyour help.

The H-1B application belong to the employer and it is up to them to disclose the information. The application receipt number will be issued to the employer if the case is selected by lottery.

I'm in a similar situation.
The only difference is I know the lawyer office filing my application, and they know me too.
So a few days ago this news broke out that lottery results are out, employers and legal representatives were notified. I called my future employer, no news. Then I called the lawyer: he said the majority of the applicants received the answer but they have a few people whose status they have not heard anything about. He said official deadline is June 2nd although I'm a bit sceptical.
I think we should have received a clear Yes or No already.

Right now I can only think of one scenario and that is the lawyers screwed up my file and it did not reach the authorities the way it was supposed to.
I would get extremely upset if that was the case.

Anyone with similar experience?

There is no reason to get upset. Even if there has been some sort of a mistake, there is nothing you can do except to try again next year.

You knew there was only approximately a 50/50 chance of being selected. You are not alone. You may even be on the wait list.

That's also the way I see it. It's OK not to get selected with my 50:50 chance (more like 1 in 3). However, it's not OK if the lawyers screwed up something despite all my stress and efforts.

Now the lawyer suggests my case is probably on the "waiting list" (reserve pool for cases that will not pass later on).
Does that sound plausible?

In your case, has USCIS cashed application money? Your H1b sponsorer can confirm that.

now this is insane. It is 10th June and they still have no news on my application. If the lawyers have screwed my application, can I sue them. Trying next year is such a huge pain. Firstly I am on OPT which expires in Sept 2008. To extend the OPT, my employer has to be registered with "e-verify" which he is not and unlikely to be. In such circumstances,if the lawyers mess up, they should be sued and screwed both. Also my employer claims that he filed my application in Masters premium quota.

I agree, after all the efforts if they mess up, we should be able to sue them. Isn't thats what for they are hired. Else why do we need immigration lawyers. But this is getting so stressful

Hi,
In my case too I have not got any application receipt number. As my employer tells it seems to be in waiting list. Whats the waiting list after the lottery results are already out? Are there any chances of being selected.
Can any one help in this.

Thanks
Nilay

well even if it was a waiting list, there should be some news by now. My employer gave a list for whose visa is approved, but still does not have any info on my case. If disapproved, the application comes back. My application is not yet back with them (thats wht they say). The bad thing is my employer is not with E-verify. So I cant even extend my OPT

In my case (General, non US master) money was debited April end, got receipt last week and is approved now. Opps relief.

I'm sorry I forgot to report back here. Employer received a big "NO" few weeks ago, along with the check. Some vague text about my visa "not selected in the random process", or something like that.
Sssshhh... tough sh*t. I have no other option but try again next year and hope for improvements in the regulations.
