2. My I-485 was rejected because of the fee.My lawyer explained that it was the fault of USCIS officer. We sent a reply letter to USCIS recently. Does anyone have similar experience? is there any hope that my 485 can be accepted? I am feeling that the lawyer have screwed up my 485.

Questions for DCMetro

Hi DCMetro,

How many days did it take between your I140 response and approval date? Attorney sent response to Education/Experience evaluation on 12/07. Just wanted to get estimate how much time it could be before it gets approved.

h1b2ndterm: For me it took about a week/10 days I guess before my 140 was approved. But then again, it was simply an agreement on out part to agree to EB3.
 
Thanks for reply DCMetro. Probably it will take lot longer to me especially being holiday season. Lets see.

Does This Happen To Anyone Else??????????

Hello
My attorney respond to RFE (A2P) on Dec 6th and got approval notice for I-140 on Dec 15th But online status still said. “ We received a response for request for funther information ……………………..” Online still did not show that my I-140 is approved.
Now I got the finger print notice (CODE 3) but online status did not show that they send notice for FP. LUD still shows 9/26/05.

MY question is that does this happen to anyone else or this is happening with me only. Do I need to be worried that may be in future my I-140 can be revisited?

ajoo: while 140 lud should be updated, 485 does not show a new lud up unitl you do you fp. I am sure 140 will update at some time..dont worry..must be a system delay..
 
Last week I called USCIS to find out about my EAD & AP. Here is the response I got in a letter to my home address.

Our records indicate your I765, AP#, EAD#, applications were received july xx, 2005 and are pending cecisions in this office.

These cases have been selected for detailed review. The process will take longer than normal processing. Should we discover information requirint futher review and verification, we will contact you, either in person or in writing to provide additional information. We will make every effort to complete this case as soon as possible.

My I140 is approved yesterday. Good luck to all. Hope I485 is approved soon too. Although I haven't received the FP notice yet.

EB2 vs EB3

I just received my Labor Certification. Minimum job requirements on the approved ETA750 are Bachelor's degree + 5 years experience. EB2 visas are current for me (rest of world), but my lawyer says we should apply for I-140 under EB3 (retrogressed). His reason is that many EB2 applications for I-140 are being denied, and that once denied cannot reapply under EB3. He says it is safer to go EB3 and then file I-485 once EB3 is current.

Any advice? Even though the LC indicated minimum of bachelor's + 5 years, my personal qualifications are actually Masters + 15 years.

Should I find another lawyer to do my 140/485?
 
What does box 14 and 15 of your lc app say.

If they say BS+ 5 years and no 'or' then your lawyer is plain wrong. Additionally if you apply in eb2, generally you'll get rfe on demoting your case to EB3 - if nsc determines so.

EB3 is gonna be retrogressed for a long-long time (will be stuck in 2001 as per pundit's predictions on this board).

Press your lawyer to file in eb2

How long I have to wait now.......

I done my Code 3 FP and my 485 LUD change twice in last 3 days. Is something is happing or it just a ..............
I am not from retro..... countries.
Can someone tell me that average how long is wait time.............. for 485 approval
 
It should not be long (unless your FBI namecheck is stuck).

Do let us know once you get the approval. My PD is gonna be current soon.

I still haven't received Fingure print notice. EAD/AP/I140 are approved. Do you know or any others in the forum who are in same situation. My PD is current too.
