I updated my information...

Got RFE on I-140 and USICS revieved the RFE info on 06/14/2005.

RFE: Why the employer is working in Dallas when the company located in IOWA.

Please let me know if any one got the similar RFE.
 
Hi All,

I am going to use a pre-approved labor which was filled in Sep 03 and was approved in April 04 in EB2 category.

How much time it will take to get the 140 approve if the company applies it in a month?

Is it better to apply 140 and 485 together or seperate?

it might take anywhere between 6-8 months, apply ASAP before the retrogression starts for EB2

apply all together 140/485/EAD/AP. Good luck

06/22/2005: EB-2 Retrogression Prediction for Indians and Chinese

* Back in March, the Department of State predicted that the EB-2 visa numbers for Chinese and Indians may start retrogressing on midway to FY 2006 and not before September 30, 2005. The State Department official may update this prediction here in Salt Lake City. Please say tuned.

I just got my labor approved and I am looking into this thread now.

Please let me know the following:

EAD = Employment Authorzation Document
AD = ?
AP = ?
FP = ?
RFE = ?

Are there any others that I should be aware of?

I-140 & I-485

Gurus, I need your help.

My lawyer told me today that concurrent filling of I-140 and I-485 is not possible anymore, because they ran out of Visa numbers.
The highly "complicated" formula doesn't allow him to take even a guess when I can file the I-485. Of course, I can file the I-140, but for the EAD I have to have a filing receipt of the I-485.

Can anyone verfy this? And where can I track the availability on the Visa numbers?

If you are filing in Employment Based 3 (EB3) category, what your lawyer said is accurate. You can tract immigrant visa availability at:

http://travel.state.gov/visa/frvi/bulletin/bulletin_2539.html

As of now, EB2 is current, but there are rumors that EB2 will retrogress as well. New availability of EB3 visas (if any) will be published in October.

You can always get all your I-485 paperwork ready so you can apply for Adjustment of Status (AOS) whether your I-140 is approved or not. If your I-140 is not approved by then, your lawyer will use I-140 receipt notice to be able to apply I-485 application.

Since I can't file I-140 & I-485 concurrently, what advantage do I have by filing I-140 now? If I-140 is approved, what does this mean for me? What can i do with this?

Hi guys,

I just received an email about my I140 approval. My case is a labor substitution case (EB3, PD Nov 03). Received RFE on May 5, and replied on June 3rd week, USCIS received on July 7th and approved on 12th.

Hope all 140 RFE replys will be approved soon.
