I am they are not approving the 485 yet. According to the C.S.R. my name check has been finished and it has been assigned to some one.

My I-140 and I-485 cases were approved in 06/22 and I have the message
"This case has been approved. On June 22, 2005, an approval notice was mailed. If 14 days ..." in both cases. It doesn't mention that the card was order. Should I call VSC or it is normal and another lud will change the message?

You will get the card ordered message within next two business days.

Today morning I received the card ordered emails though our cases were approved on 6/20.

Applied Electronically on May 19th. Gave Biometrics on June 2nd. Sent supporting documentation around May 25th.

Took around 35 days in all.

I am still waiting for Advance Parole.

How come I got 10 emails, 5 each?

Hello all:

it seems like this is going to be a loooong summer for all of us waiting for our green cards in EB-3 category. Can all these people please confirm if their case is still pending as listed in the last version of the spreadsheet. It seems like with all the cases approved in last 3-4 months, these cases have the oldest priority dates before the last published date of 06/01/02 and have had their fingerprints taken in Q1/Q2 of this year.

I can just hope that all of EB-1 and EB-2 cases that are pending are approved in the next 3 months, so come Oct 1, INS just approves all our remaining EB-3 cases!

from approval of file040505,zbcx123 and ers_md it looks like USCIS is processing for fp done date of 04/07 to 04/14..

Approval of gcalb,rrml,harithpatra,jd_mass,ny-quant,abc_xyz etc. in next few weeks will make sure that ,this is the way USCIS is processing presently atleast for EB2s.

What is up folks - see all of you are down? It is still 5 days to go! Come Oct 2005 - you will again see rain.

A better way to cross this phase is to start time pass questions - I used to do those last year when the officer working on EB2 case went on long vacation followed by pot smoking session. Come up with questions and you will see 8-12 weeks will fly!

My guess - initially dates will move backwards by couple of weeks(depend on backlog reduction center's speed) and then move a little further, followed by visa release for all EB3s in third quarter of 2006 (not just RN and PT this time). Why for all? Cause USCIS delivers best shows - its objective is to show that back-log is under control. Next time before declaring visa unavailable they will like to clear more and more cases, else backlog will grow again and it will be under pressure like it once more as it was in 2004!

You are going to get a concurrent approval or one with short time diff in 140 and 485.

Your RFE was rather straight I guess. Maybe you are in name check loop. When u will get it done (which will be change in 485 LUD), 15 days or less after that.

I would suggest asKii (no typo with K here) - raise a query on 485 - it will help your case. You can do that yourself, if you want!

Sorry for not posting for a long time. Was trying to save my current consulting position and following with Laywer and employer to file.

My 140 RFE was filed on 06/21/2005 and USCIS received on 06/22/2005

Any ideas how much time it will take for USCIS to make decision.

Yeah you are right - that is the default reply nowadays and no one knows how to circumvent it and how to query on that for a long time - so I have stepped back in.

I recd only few pms and even less emails.(actually much less nowadays - perhaps you people have written me off ) - that was another reason - I thought everyone is happy since I left.

Let us see your case for example:

Dates specifics:

This case qualifies by all means for adjudication.

Steps to follow:
1. Raise a formal query with VSC on reasons of delay. (for representation).
2. Contact FBI to find status of your name check. (for U)
3. Call FBI to find if FP was OK. (for U)


Once you get response from VSC stating same bullshit - security check pending due to lack of manpower/fund, prepare a representation thru senator/congressman's office from your area. State your agony and pain of wait of so many years AND question How did VSC decide no to send your case for security check when you qualify by all means - PD, ND, published date on USCIS site and visa bulletin? Also be suggestive to put your instinct if you feel it was discrimination!

Always attach print-out of relevant uscis dates and visa bulletin dates.
(for people who will see this post after June 30, 2005 - get old visa bulletin).

What will this do?

You think you will not get adjudication and you maybe right. But if you think you cannot force VSC to work on your case and keep it in adjudiction ready state - you are wrong!

This will give a hard time to folks in VSC - they have to give a concrete reply. Even if they reply that they are not working on EB3 cases(which is likely), ask again thru represntative's office - why was it not worked upon till June 30, 2005 and that is more pertinent considering that the published dates suggest that VSC has worked on cases with PD later than your's (uscis website) AND the dates in visa bulletin! Insist on why part of security check delay!

There is old saying in NDA(Khadakwasla, Pune) - the more you sweat in peace - the less you bleed in war. Prepare for assault - corner VSC in these few weeks - your case will be adjudicated in first go when Visa opens up again.

Your target should be to keep senator's office (and VSC) focus on the question of why delayed!
